  • Moorside have paid their court fee so the hearing is to proceed. Better get busy and write a Witness Statement.

Do you have any photos of the signs?

I'm a random person on the internet. I hold no legal qualifications and nothing I say is advice.

  • Yes, I have photos showing that there were no signs in December 2022, so just prior to my alleged breach. I also have photos showing very poor and inadequate signage in May 2023, so just after my alleged breach. These include their own photos of me leaving my vehicle and heading to the medical centre next door - not a sign in sight! Then I have photos showing the plentiful, unmissable, improved signage following the then Transport Minister (and local MP) Louise Haigh raising the signage issue with UKCPS on behalf of her constituents. She stated that in her opinion, the signage was inadequate. The company then improved it, which I see as a tacit admission of its previous inadequacy. I have her written statement to that effect, plus a screenshot of her parliamentary blog stating that UKCPS improved the signage following her raising the issue with them.

    And include as exhibits:

    • HHJ Moloney's judgment in Beavis …see the WS by @JackR1
    • the CMA's Open Letter to the parking sector this July where they pointed out that the self-serving Code of Practice isn't 'the law'…the Consumer Rights Act 2015 and the DMCC Act 2025 is the law and signs & terms must be prominent and fair.

  • I’ve got their WS now. Their claim in monetary terms comes to over £500, including “Advocate Attendance”.

  • Did they provide a picture of a sign? If so, could you share it?

  • I’ll do it tomorrow morning.

Only it doesn't amount to that really, they lied…because small claims doesn't allow extra costs like that unless you act wholly unreasonably such as failing to put in a WS or failing to turn up at the hearing.
