No, it is not. The police officer is classed as an Expert Witness and because of that his training and experience lead him to have the knowledge over a reasonable person to give legal opinion on the standard of the tyres, brakes, etc.
He does not need to be a "tyre expert" he can just give Expert Opinion that the tyre is knackered and that is enough for 3 points & £60 fine.
Keith, can I ask how you came by this information? A police officer's opinion is not evidence of an offence in a situation like this where there is a clearly defined limit. Measurement of the tread depth is. You can't look at a tyre and see (reliably) the difference between 1.5mm and 1.7mm of tread.
If the officer suspects you have been drinking, a calibrated instrument is used to determine the level of alcohol in your blood. He can't go to court and say "well, he smelled a bit boozy". It's no different with the tyre.If you lend someone a tenner and never see them again, it was probably worth it.0 -
magistrates have a knack of siding with the law officers. Even if you have a fairly solid defence, expect to find yourselves looking at either taking what is dished out or going through the appeal courts.matched betting: £879.63

I'm confused. You say it's not your car but your cousins that you borrow ocassionally yet you then say you are replacing the tyres etc.
I know as the driver you are responsible for any defects while driving but I don't understand why you are maintaining a car you don't own but just borrow?~Laugh and the world laughs with you, weep and you weep alone.~:)

This story seems like something Walt Disney would make up.
He's been stopped many many times while using other peoples cars according to him, well according to him at first before people had a go.
He used to borrow cars a lot so he didnt have his own insurance, he would just get temporary insurance for loads of cars as and when. Now he's just sold his own car and is saving up to buy a new one. Hang on, he ALWAYS borrowed cars when he first posted.
He started off saying that the police pulled him because he was young and now he is an optician using a company car. I just fell off my laughing at that one.
Oh and its not his car he'd just borrowed it but he's replaced the tyres took it for an mot and had the brakes checked out.

The car is no mine, it belongs to cousin who used to give it to reps. As dont want it no more i am borrowing it. The only thing thing he got me donw for me was MOT and TAX, everything else im paying for. Why should be pay for new tyres if im the one driving the car. Buy insurance is not a problem for me, why risk losing your licence and fines for hundred quid.0 -
And constantly getting temporary cover notes is going to end up costing a helluva lot more than actually getting a proper insurance policy, building up a no claims discount and then transferring the policy year after year to get the premiums down.
Unless of course a few little porkies are being told to the insurance companies and then changing company prior to being found out............"Life may not always be the party you wish for, but whilst here you may aswell dance"!!!

There no need for my cousin to sign over the car to me, im using it for a couple of months tops. The cars his so the V5 stays in his name.
The reason for using temp cover is so i can switch it on and off. Im working in central london so i cant drive to work and therefore use the tubes. So i only pay insurance when i need the car on my cover days. It only cost £11 a day and saves me paying the annual amount.0
