Stopped by police, Problems with producer HO/RT10

On 26th December at around 10am I was stopped by police on my way to work. After looking at the car police decided to give me 3points on the spot for defects to the car. The defects where regarding the tyres and the breaks. From what I saw the officers only examined the car with a torch. My argument hear is that the police officer can not give me points by just looking at the car. To examine breaks the wheel would need to be removed, believe because my dad is mechanic who has working for over 30 years (Two more mechanics examined them and they said there working). Whereas for the tyres, the police did not have any kind of measuring equipment to check the actual tread on the tyres. The car also passed its M.O.T only 2 months. What got me angry was when the officer said to me “I wish I could give you more points”, can they even say stuff like this the public. As I use temporary cover insurance, I did not have a cover note with me. I was given a Producers form. A week later I went to the police station to produce my insurance documents, the officer behind the desk simply goes to me she wont accept it as it was past the time the ticket was given. She then said
I will be summoned to court for driving without insurance.

What are my rights?
What do I do and what can I do?
Can I stop getting the points for the defects?
What happens when I get to court?

If it helps you, I have been given speed points in the past but they were cleared after 4 years. I currently have 3 points for red light offence.

    it's very easy to see if a tyre is below the legal limit. the tyre has inbuilt little rubber bits that show if a tyre is within the limit.

    brakes is harder to tell, unless they observed you stopping and were concerned.

    an MOT means nothing. it's just proof that on the day the MOT was done it was roadworthy. it doesn't mean your tyres will be okay for a year or any other length of time.

    why do you use temporary cover notes? sounds very dodgy to me. that's usually done to get a certificate and then payment is cancelled (and shortly afterwards so is cover). don't you have a cover note covering the date of the incident? if you don't, and you can't provide details of your cover, then you were driving with no insurance, and could be facing a ban.

    amazed that you seem so clueless given you've been brought up by a mechanic :rolleyes:

    sounds to me like the police were absolutely right.

    What was the reason you were initially stopped?Why did the date on your cover note not tally? Why did he need a torch at 10 am? Did you produce the docs within 7 days? There were 2 police officers who witnessed this? There is only one of you? I suggest you get a solicitor.

    and if you have 3 point for a TS10, and another 3 now for the tyre, the minimum you'll get for the IN10 is 6, so you could lose your license for totting up.

    Good advice but I belive the wear markers indicate when you have got to 3mm of tread left where as the legal limit is 1.6 mm of remaining tread. You cannot conclude that the tres are illegal just by looking at the wear markers.

    Notwithstanding that, it probably a good idea to change the tyres when the get to the wear marker (3mm) as 1.6 mm of tread is not safe IMHO.

    However, I always recommend starting to shop around for new tyres as soon as the old ones hit the 3mm mark. Below this, the amount of grip evidently decreases significantly. This is not good, especially at this time of year.

    This is also another reason that I get my oil & filter changes done by National Tyres: they always check your tyres, to see if they can sell you some new ones. As a result, I get a free professionally-taken set of 3 measurements across the width of each tyre every 5000 miles/6 months!
    The acquisition of wealth is no longer the driving force in my life. :)

    It sounds as though you failed to produce the insurance in time - was it a week and a few hours after the incident that you produced it? (I'm surprised they are that fussy though)

    Or was the cover note not for the period you were stopped.

    I'm pretty sure most brands have the indicator at 3mm. This is because in other european countries the law requires you to have deeper tread than in the UK. I recently changed the tyres on my car, they were down to the wear indicator and had 3mm of tread left.

  • Thanks for the quick reply. the reason for me using temp cover insurance is because the car belongs to my cousin and he was lending it to me for a few week as i have just sold my car. with temp cover you dont get a cover note sent in the post, they email you a pdf and you print it off. I was stopped by two officers and was by my self. the tyres is something i can take the blame for as it was on the legal limit as my day told me and so did everyone else when they checked the breakes. as for the producer form i was told i had 7 days to had in the documents, that would mean 2nd jan. i went there on that day at 9pm where i was told i had taken over 7 days. thats what my agrument is hear as they are trying to do me for no insurnace even tho i have brought it and it something i wont take 6 points for. the tyres are my fault and im willing to take the blame and the 3 points. i have spoken to a family friend who is in the police force and he told me to speak to a motoring lawyer and also contact the CPS.

    They are probably not " doing " you for no insurance, but for failing to produce your documents within the legal time frame, 7 days means 7 days.

    Why did you not take them sooner?
