Stopped by police, Problems with producer HO/RT10

    Im taking the points for bad tyre, as its my fault. Its being done for no insurance. Im might be young but im not stupid enough to drive without insurance. I have contacted a motoring lawyer and they will be writing to the CPS on my behalf pleading not to prosecute someone for being 10 hours late. They told me they dealt with simular cases and have been succesful.

    Also why would i want to lie to you lot if all i want is advise.

    Surely it gives details on the hort10 as to timescale?If you are not sure what you have been summonsed for go back to the police station and ask them to look at the document they filed in.

  • Yes, i will be able to show my insurance certificate.

    Im just trying to avoid going to court because i dont want to pay for lawyers and other cost and take time off work.

    Last time I failed to produce in 2001, I was told:-

    You should return to the police station and produce the cover note. They will add it to the records and give you a note of which page it is recorded on, it can be written on your producer.

    I was eventually summonsed for driving without insurance, and had to attend Court 3 times, at each hearing I produced my cover note and producer showing that it had been produced but was late.

    I then had to attend a Court office and give a copy of the insurance note to them so they could check it was valid.

    At this point I was found not guilty.

    There is no need to pay for a Lawyer in a magistrates court.
  • Is it not possible to contact the CPS before the case even gets to court. I spoke a motoring lawyer today and he said he has dealt with simular cases as mine. he said he wrote a letter and sent the orginal cover note to the CPS, they decided to drop the case as they knew they where going to prosecute somebody for turning up late.

    from my understanding it goes

    23.59 / 5th Jan
    00.00 / 6th Jan
    00.01 / 6th Jan

    i don't see how when it hits the stroke of midnight it is the 5th or 6th of Jan!!!

    so does this mean i should of been able to hand in the documents at the time i went . A friend of mine who is police officer told me at his station its work like this: Get Stopped on 1st July Monday at 10am then you have until 8th July Monday 1159pm. He works at a 24 hour station.
  • Irrespective of the time 23:59 or 00:01 the actual offence is failing to produce your documents when requested to do so - i.e at the side of the road. The law accepts that carrying your documents is a hassle and not always convenient and therefore gives you seven days from midnight to produce your documents at a station of your choosing.

    If you fail to do so within the 7 days and you have a certificate of insurance then as long as you produce these to the court then you should be okay.

    If today was the 1st July then you would have seven days from midnight tonight to produce. The rear of the HORT 1 spells this out
  • I find something amiss here

    First a PDF "cover note" would not be acceptable, all insurers send out original ones

    I used to get insured at intervals on another car and I always received a cover note,

    Yet you who didnt have one then, had one to present 7 days later which would at best have been 4 working days including the day of request

    I find your whole post dodgy

    Also I do not think you were insured

    You probably ran home insured yourself from then and hoped the police didnt notice

    Generally I think we would be better off without you on the roads of britain going by your attitude, lack of care and general lack of knowledge as to the law

    Also the law doesnt allow for you necessarily to prove it later, you arent being charged for no insurance, but a seperate offence, given you accepted another offence at the time I just wonder how sympathetic they will be to you

    Frankly If it was me Id be there the next day or the day after as would most normal folk

    Stretching it out is asking for hassle
