This morning around 7:45am I had a bailif at my front door 

Another thing to add is I believe the car that committed the offence maybe has cloned my plates which I made aware when I submit my set aside form as I have an insurance claim from around the same time in which an engineer was sent to look at my car and found no damage on it. 

I also to avoid extra charges tried to pay the fine using the phone (automated robot payment) when I initially called it was the amount of 749 but if wouldn’t let it go through so someone then answered the phone and told me it was now upped to £958 because it was escalated to the high court. 

The CCJ judgment was made on 16/12/24 I received the letter on 19/12/24 and called to make payment the same day so in the space of 3 days the case was escalated to the high court.

ive recieved no reply from the court on the status of my case (set aside) I really don’t know what to do 

The bailif was told I sent an email to set aside the case and he told me I kmow owe 1651.47

So, to my (untrained but experienced) eye, this looks like it's in breach of bailiff law, read this:

- you didn't receive a Notice of Enforcement' before this? You can see from the link that they have to do this first (before they can add the first capped fee of £75) and they must then give you 7 days to deal with it.

- Did you get no document called a 'Notice of Enforcement'? I've seen this before from DCB where they told a lady within 3 days of judgment, that her debt had increased by c£200. Same as you. Read the thread by @So_Jacob

- you said "someone then answered the phone and told me it was now upped to £958 because it was escalated to the high court" just 3 days after the court judgment letter. Errm, no. Looks like they lied and randomly added over £200...thank goodness you didn't pay!

- the HCEO has left you with a completely misleading and inappropriate letter (with no Date of Issue on it) which says - untruthfully - that they've already taken control of goods and somehow the £749.08 has magically morphed to £878.83 - no explanation and that's not including the £75 compliance fee!

- and this undated letter headed 'AFTER ENTRY OR TAKING CONTROL OF GOODS' has then added together Enforcement stage One (£190) plus Enforcement stage Two (£495) - neither of which has happened - and called it 'Enforcement Stage fee £685' and added that to the imaginary £878.83.

Please - if you are a robust person - could you ring up DCB Ltd on Monday next week (only AFTER applying to stay the Writ) and RECORD THE CALL AS EVIDENCE and say:

1. I'm recording this call and no doubt you are, too. I've applied to stay the Writ. The Judge will have rubber-stamped the application by now and a hearing will be set. Call your HCEO off immediately.

2. Show me the a 'Notice of Enforcement' that you reckon was served. When? It wasn't, was it? Doesn't exist, does it? Are you going to pretend there was one?

3. When emailing me your supposed Notice of Enforcement, also explain the EXACT breakdown of why I was told on the phone in 19th December that I had to pay £958 'because it had gone to the High Court'.  Don't make it up. I want a complete breakdown to explain that figure, by email NOW.

4. Why has your agent, who has NOT entered the property nor listed controlled goods in an inventory, left me with a letter headed up saying he has done, and he has added the compliance fee, plus Enforcement Stage One and Enfacement stage Two to try to mislead me that I owe £1652.47?

5. if I was to pay you today (WHICH I AM NOT BECAUSE I'VE APPLIED TO STAY THE WRIT) you must include in your email a FULL quantum breakdown, with the starting figure being the £720 ordered by the court, telling me exactly how much you think you can demand today and why, given you haven't even issued the Compliance stage notice to add the (capped by statute) £75?

THE WHOLE POINT IS TO RECORD THE CALL AS EVIDENCE OF UNREASONABLE CONDUCT AND IF YOU SHARE THE CALL WITH ME I CAN SEND IT TO THE GOVERNMENT LIKE I DID WITH THE RECORDING OF WHAT DCB LTD SAID TO @So_Jacob

So - don't record your name or the name of the person who answers.

And don't try that until Monday, a few days after your application is in.

You must hide your car in a garage NOW and make sure nobody in the house lets the HCEO in because they'll come to clamp vehicles that they think are yours first thing tomorrow at 6am or so, or they'll knock and hope they can trick someone to let them in 'to lean on the table to write something' or to 'get some water' hoping to lIst an inventory.

Once let in. they're in. Prime everyone.

This is a dangerous time. You should have asked us earlier. We'd have told you before Xmas to do a N244 to 'stay the writ' (because the sum exceeds £600) and it would have been done months ago, without bailiffs knocking.

I moved my other one but I have a electric car on my drive that full of mould that doesn’t move and doesn’t work at all

@Coupon-mad I just went to the court they said I needed an appointment they then told me they don’t have anyone working the counter then she said give it to CNBC and it’s an online case 

I just dropped it off in the documents drop off and I couldn’t pay

No HCEO at the door today, but looking at the letters when I tried to pay on 19/12/24 and they upped the amount owed but on the HCEO letter it says the High court judgment was made on 24/12/24 can this help my case?

Yes indeed.

It looks like a pack of lies since Xmas 2024, doesn't it?

Hopefully the application will be passed straight to a Judge but ring the court tomorrow morning and insist.
