Help Defending A Very Silly PCN From UK CAR PARK MANAGMENT LIMITED

Hi Folks, Unfortunately things have started to heat up with a PCN I received on the 09/04/2024 and after nearly a year of silly letters from various greedy gits I have finally had an official claim through.

My wife did initially appeal but obviously got rejected as we didn't really know what we were doing and thought these people would show some humanity in the matter due to the circumstances. I have already responded to the claim using your helpful guide in the Newbies Thread and completely denied any responsibility to there outrageous behaviour. Now I need to put a defence together and send it in by the 05/04/2025, I hope you can help.      

Let me run through what happened, my wife had booked a play session for my daughter aged 2 and my Son aged 3 months (at the time) at a play centre called GLOW BABBIES on Hastings sea front. The play centre is a hired space situated on the ground flour of a block of flats that has a car park out the front. I drove into the car park like anyone surly would presuming this would be ok to help my wife and young children out of the car to attend the session. I cant of been in the car park for more then 5 mins before exiting to do some errands then returning to pick them up. A few days later we receive a letter requesting payment for parking in the car park for, stating I parked my car 1 hr 37 mins which is false as I have proof I was elsewhere in the car. We both had a good laugh and decided this outrageous claim should be ignored. Anyway now Gladstones Solicitors are involved on behalf UCPM and have made a claim against me. 

I have put a link to the location of the car park and signage if you would like to take a look. I feel the sign is inadequate and would hate to think how many young families have been caught out by this honey trap. The address to the car park is

    first of all make sure that you do not attempt to guess as to who could have been driving  never used terms like i did this  he, she, husband, wife etc
    From the Plain Language Commission:

    And what's the date of issue of the Claim Form and on what date did you do the AOS?

    Particulars of Claim

    The driver of the vehicle with registration (Removed by Forum Team) (the 'Vehicle') parked in breach of the terms of parking stipulated on the signage (the 'Contract') at QUEENS APARTMENTS HASTINGS (ANPR) - THE QUEENS APARTMENTS ROBERTSON TERRACE HASTINGS EAST SUSSEX TN34

    1JA, on 09/04/2024 thus incurring the parking charge (the 'PCN'). The PCN was not paid within 28 days of issue. The Claimant claims the unpaid PCN from the Defendant as the driver/keeper of the Vehicle. Despite demands being made, the Defendant has failed to settle their outstanding liability. THE

    CLAIMANT CLAIMS

    £100 for the PCN, £70.00 contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £11.04 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at £0.04 per day.

    With a Claim Issue Date of 3rd March, and having filed an Acknowledgment of Service('AOS') in a timely manner, you have until 4pm on Monday 7th April 2025 to file a Defence.

    That's four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.


    You need to be aware that those Particulars of Claim are totally inadequate.

    So it is alleged that the driver 'parked in breach of the terms of parking stipulated on the signage (the 'Contract')'.

    Nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.
    This will be an easy win.
