Hi All

I have had a letter of claim sent to me by dcbl after ignoring everything from euro car parks and others sent to me previously.  I overstayed at a carpark 11 minutes after the free time.  It was a place where you could only get a ticket by a mobile and I didn’t get one as I thought I’d only be a few minutes, but got delayed and overstayed.  Is there any recourse for this or should I just pay the fine to avoid going to court?

  • They gave me a ccj just saying. Dcbl for eurocar parks. I was 6 hours from home. Am disabled and needed to charge my fully electric vehicle for 2 hours to just get me some of the way home. They said no you had a 30 min limit. And I sent them my blue badge. They are crooks and they won’t be lenient.

    There is no fine,  just an outstanding invoice from the private parking company,  in this case the Letter of Claim is actually from DCB Legal on behalf of ECP ( I doubt that DCBL ( debt collectors   ) sent it,  more likely to be DCB Legal,  the legal company   )

    Study the second post in the newbies sticky thread regarding a Letter of Claim and respond by email to DCB Legal by email with the response template 

    Court is a long way off, even if it got that far, they usually discontinue if you defend a claim properly with advice from here

    Its those who don't follow the advice here that lose out

    The only way you could have got a CCJ would be if you ignored a court claim form, which none of our advice tells people to do. Or if they sent the claim form to an old address.

    None of this will happen to this OP.

    Why are you telling posters that you got a CCJ when you say on your thread that you didn't?

    Please explain that on your own thread, not here. This thread belongs to somebody who won't get duped into paying anything to scammers.

    You WILL NEVER PAY THIS and it isn't a fine.

    You do not want to avoid the claim form; that's exactly what everyone wants!

    You are in no danger of a CCJ (at all) if you simply follow the advice already in the second post of the NEWBIES thread. Dead easy.

    I've had a look at the post you recommended, but here's quite a lot there to get my head around.  Is it to send this template?

    The alleged debt is disputed and any court proceedings will be vigorously defended.

    I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

    I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

    Don't send me your usual blather about that.
    I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yes that is the template that you email to dcb legal,  in response to the Letter of Claim 

    A Letter of Claim precedes the actual court claim,  so yes you take action by responding to it

    The court claim pack from the CNBC in Northampton is next and to be dealt with,  probably arriving in March this year 

    A court claim form is the start of the process,  only near the end of the game do we know if the game is going to penalties in an actual courtroom,  or not.  So going to court is not inevitable,  many cases don't get that far if the defenders play well

    I'm trying to find an email for dcb legal, but am struggling to find the right one.  There is a response form on their website, so I need to put all the info in there? I don't want it to go to the wrong place.

    Coupon-mad Ok thanks.  Have done and think it must be to come as seems to come after LoC.

    What would be the defence for overstaying?  it was only by 11 minutes as I was delayed and didn't get a ticket as I though I'd only be 15 minutes?  I didn't appeal as it seems like a waste of time and another charge I had just went away after I ignored them

    You'd use the Template defence. Doesn't need detail and you certainly don't admit to overstay.
