Landlord want us to go direct , advice please

    Compare the two contracts side by side, and word for word - check that they are exactly the same, all barring any dates etc which will obviously differ. 

    Personally I would also be politely informing the LL that there is no contract between you and the agency FOR you to terminate, that you are quite happy (as long as the two contracts match) for him to rent directly to you. If fact, assuming the two contracts match, I would just be signing that, returning it to the LL and saying nothing further about any sort of contact with the agency. Once again, the agency and the LLs deal with them  are not your problem.

    Put in writing to the LL the date of your final rent payment made to the agent too - and ensure that you have his bank details ready for the next payment.

    pretty obviously the LL was simply looking to drop the agency and therefore save having to pay them commission. He is not looking to lose a tenant, just save money on fees. hence his willingness for you to do it as early as possible.

    That’s exactly what he have told me a while ago. But I wanted to be on safe side in case he want to stage us .

If a tenant leaves, you could terminate the agency contract with no termination fees as long as you hadn't already asked them to find a new tenant for you. Your landlord is most likely looking for a creative way to end the agency contract without being liable for their termination fee.

    Yes - the two possibilities that I think were occurring to most of us were 1) that the LL was using a sneaky means of getting the tenant out or 2) that the LL wanted the tenant to essentially make a false claim to the agency in order that they (the LL) could avoid paying a termination fee. Neither position would be exactly ethical, IMO.

    Seems as if people didnt pick up on my prior point but option 2 is exactly what our LL wanted to avoid, they had to effectively continue paying the agency if the landlord was to terminate the relationship and we were to remain in the property. If we were to terminate then the landlord could end the agency agreement without penalty. In our case however the LaL was willing to offer an incentive to go along with their plan.

    I think that’s exactly what it happens in our case. He have sent new contract to us to sign from end of the month. But still want us to confirm Termination date with agency

    You do not have a contract with the agency. So you cannot terminate it.

    If your terminate your rental agreement with the LL and stay beyond that date, he can charge you double rent. 

    He may be trying to avoid termination fees with the agency but he needs to understand the jeopardy he is asking you to accept (like no roof over your head).

    We already have signed new contract with him and we got a copy. And i have emailed the agency to terminate the contract with them. And i think he do want to avoid paying them fees with agency.

    i don’t think we can be in trouble if we have signed new contract with him but also cancelled the contract with agency
