Any reason the landlord can't issue you a new contract now? Dated February or from the date your notice would end with the agent?
I would tell him that until you get a new contract you don't want to give any notice to the agent and you feel uneasy about the section and would like the new contract now.0 -
I have said that I would like new contract, however he said that he will give me one after the agency will confirm the termination date which is end of the month. That’s why I’m really concerned if he can kick us out at the end of the month if he decide to change his mindhousebuyer143 said:Any reason the landlord can't issue you a new contract now? I mean this seems like a really convoluted way to kick you out, so maybe he's just confused. Either way I would maybe just tell him you are happy to wait until February for the new contract with him directly and ask him to issue the new one from then but issue it now dated for the future.Will123321 said:

I personally wouldn't give notice to leave to anyone. If you don't leave at the end of the season 21 then a court needs to remove you, I am not sure what happens if you give the notice and don't go though.
To end management with an agent I have never heard of having to do this. The landlord normally gives the agent notice and then it ends. The tenancy remains unaffected.0 -
Get the idea out of your mind that the agent decides who can and cannot stay in the house. The landlord decides. If the landlord has a problem with the agent (and I've yet to deal with one who gets things right) then your best bet is to have a proper conversation with the landlord about what he wants to do with regard to the house, and the management of it.
Mr Generous - Landlord for more than 10 years. Generous? - Possibly but sarcastic more likely.0 -
Well, we had a conversation and he said that we have 2 options, waiting till end of tenancy to renew the contract with him directly, or finish earlier and get direct to him earlier. The contract is short term 6 months. We have asked the agency about it and the landlord mentioned to tell the agents that our termination date will be end of the month, and once that is confirmed he will give us new contract.Mr.Generous said:Get the idea out of your mind that the agent decides who can and cannot stay in the house. It’s my first experience doing this , and obviously don’t want to take the risk ending up on the street. Landlord said he is not happy with agency and wants to take over. Don’t know why he issued us section 21, but he have told us in advance about ithousebuyer143 said:

If he doesn't give you a contract, and you haven't given notice then you don't leave at the end of the section 21 and he then starts court proceedings. You probably then have a few months to find something and leave before it goes to court.Will123321 said:

I imagine though he will issue you a contract because it does seem too convuluted to be honest, as he could just tell you you need to go rather than make this strange story up.0 -
And if we give the notice to the agency and the landlord won’t give the contract, would we will have to leave on the termination date we have given ? It is a complex situation, but I want to be on a safe side , especially before Christmashousebuyer143 said:

I'm not 100% sure if you give the notice what happens if you don't go, but I imagine you have less rights. I'm sure someone else will be able to answer that one though.Will123321 said:

You said the landlord gave you two options with one being the Feb date. I would therefore take him up on that option over the one where you give notice to the agent.0 -
Just e-mail the landlord and ask him.Mr.Generous said:Get the idea out of your mind that the agent decides who can and cannot stay in the house. The landlord decides.
