How I would go about is if I should have £100 bill credit and owe £100 then the balance of the bill is zero once the Ombudsman's decision is finalmasonic said:
There won't in fact be any credit balances, but those owed compensation would be treated as creditors to the business and they'd normally be low down in the pecking order, so likely wouldn't be paid after what little cash was available went to priority creditors like employees claiming wages and HMRC claiming VAT.HillStreetBlues said:
I have been wondering that, but as TE bill in arrears it might not need protecting, as their users are debtors, not creditors.masonic said:If they are going to imminently fail, then it is not at all clear whether unpaid compensation would be protected in the same manner as a credit balance on an open account.
It could be different if they were told to make a compensation payment in cash and they haven't paid that, as that might be considered a separate payment.

I can't login to myWatts today. A message flashes up but disappears before I can read it & I'm taken back to the login page.
Cookies cleared & password autosaved, so don't think it's a problem at my end.1 -

Great spot. I wonder how long the period is from notice of default to actually defaulting? It doesn't look good for them anyway.GingerTim said:I think we missed that Elexon issued a notice of default against Tomato on 7 January (we had of course seen the notice about Tomato's failure to meet EFR milestones in December 2024).

https://elexonexternal.newsweaver.com/924j6pkkru/10hqvmj67efIt wasn't missed. It was discussed at length here. Elexon decided not to take any action beyond making the announcement, but reserved the right to do so in future. Could be that after another quarter things haven't improved. Still no official news on enforcement action or expulsion.5 -
I just checked mywatts, as it was ok when I made my earlier post today, but yeah same problem here as well.0

The problem with this view is that if you relaxed these fines you would essentially be giving new entrants a free pass for basic incompetence.WibbleBaaaaaa said:QrizB said:TroubledTarts said:a message from their CEODo we believe him?Of is this just PR spin for Elexon (or someone else) stopping them from taking on more customers?Have there been any announcements from any of the industry bodies?
Hopefully this is as he says, they are being overwhelemed and they need time to get on top of it all and sort out issuess, because i and every other TE customer do not want to see them going down the toilet because of fines imposed on them by ofcom for failed switching, because the only people this will impact at the end of the day is TE customers, and not those who's switching failed for whatever reason, and we need more suppliers in the market, not less, and this whole fines for failed switching seems to me to favour the already big 6, while making it harder for smaller ones to start up and get a foot hold.
How much did the big 6 get fined for ignoring back dated billing rules?0 -
MyWatts back up and running3
