Car mis-sold by Audi dealership

So do you want the money or not.DT03 said:
It was not a built to order spec and I think you could be right in your analysis of the salesman’s actions. The car is insured as a 35 as that is tied to the registration. No, we have not heard anything back as yet. I’m not sure what to expect and it’s not about the money at this point it’s the absolutely shocking antics of the salesperson and, subsequently, the dealership who don’t seem to be overly concerned and wanting to distance themselves from it. The 7 day offer is ridiculous - 7 days or what, do nothing? They have to at least acknowledge this for what it is - fraud.
If £1K is not enough go back & argue for some more. But hurry up. Only a couple of days left. End of the day, you paid for & got a 35. While you wanted a 40, you did not pay that price.
What Audi do in terms of the rouge salesperson is up to them. You have no input on that. That is their internal process to deal with.
End of the day, if they are no longer working there nothing they can do.
Yes frustrating. But you have to tell Audi what you want if not happy with the money. As to the rest, nothing you can do.Life in the slow lane0 -
This is this issue with any ‘complaint’.Herzlos said:I think if you had the 35 for a year before noticing it wasn't a 40, that you're obviously happy enough with the 35.Given it seems to have been a 35 on the paperwork and the cost is correct for a 35 it seems you were sold a 35 that for some reason had a 40 badge on it.So I'd just take the £1k and keep the car for the remainder of the term.
What does the finance company think it is? Because that may be the sticking point.Everything will relate to a 35.0 -
It is not clear that "everything" relates to a 35 the OP has not confirmed.cw8825 said:This is this issue with any ‘complaint’.Everything will relate to a 35.
We have that the DVLA V5 states "35".
This was, apparently, a paperwork error.
We do not know what the paperwork provided by Audi said - the quote and order paperwork (formal order, not just casual / conversational e-mails).
Perhaps the OP will confirm?0 -
Did you pay an initial deposit when placing the order ? At this point did the paperwork reference it was a 40 rather than a 35 ?0

The implication in a previous post was everything rather than just the V5:Grumpy_chap said:

The picture sent - by the dealer - showing the 35 car with the 40 badge stuck on the rear. That’s a pretty clear action of claiming something is, what it isn’t.cw8825 said:
Playing devils advocate.jbainbridge said:As others have said - this is surely fraud.
The salesman acts on behalf of the dealership - even if he is no longer there they should be resolving this.If all the paperwork suggests a 35. The car is a 35. The op is paying for a 35
where is the fraudWe have not asked if the OP has this picture still and does it include the number plate showing it was the same car.0 -
Thanks - and I did see that reference to "all the paperwork" but, AIUI, the order paperwork would exist well ahead of the car being registered (or mis-registered) by the DVLA.eskbanker said:

The OP has been asked several times the direct question about the order paperwork and has not directly answered in that respect.
If "all the paperwork" had the 35 model referenced, it makes no sense at all that the Sales Person at the Dealership would exchange the badge on the 35 model car to make it look like a 40 model car. The Sales Person would simply point to the order paperwork showing "35" and the DVLA paperwork showing "35" and the car model badge "35" and say all consistent. The whole thread and the whole premise as stated in the OP would be irrelevant as there would be no "paperwork error":DT03 said:we got a new Audi A5 40 tfsi black edition on PCP from an Audi dealership. The salesman sent over the paperwork and my husband noticed that it was registered as a 35 tfsi which he brought to their attention. The salesman came back and assured us that it was an error with the DVLA and took a picture of the car with the badge showing 40
my husband kept in communication with the salesman over the paperwork error.
Turns out that the car was indeed a 35 and not a 40 as it had been sold as.

This rogue employee needs to be banged up for a good few years. Where has he moved on to? How many more new cars has he re-badged? Police need to be involved and he needs to be taken off the streets for everyone's benefit.0

OP said in their opening post they picked this up at the time and raised it.Hoenir said:
In my personal opinion the average punter spending that amount of money would question the correctly issued paperwork at the outset. If it didn't relate to the car they were expecting to purchase.Ibrahim5 said:How many more new cars has he re-badged?
They have been on the forums since and not responded to questions asked which would help clarify0
