The more that gets revealed (slowly) the harder it is to believe the car was mis-sold, maybe OP wanted the 40 but the 35 was available sooner and is now having buying buyers remorse

They were sent a picture of their car with the 40 badge on it. (Admittedly to be confirmed by the op).Would I have taken it? Entirely valid question. I’d have probably done some more research and found out any other difference to tell them apart to check for myself. There will be something, be it under the bonnet etc that is different and distinguishes the two power outputs.I’d base my final decision off that but would be asking for the paperwork to be corrected.2 -
Sales person was the point of contact. Nothing to suggest that the dealership was aware. Why would they? They sold the vehicle on their books. All the paperwork will support that fact. The only evidence to the contrary is a picture of a badge. All communication was with someone who has since left the business. Therefore cannot be questioned.Desmond_Hume said:

All the paperwork says 35.
The badge says 40.
The badge is cheap and trivially easy to change.
The badge is meaningless.
IF the OP still has the photo the dealer sent, that might mean something - or the factory might have misbadged it.0 -
If the badge was 40 how likely is it the the sales person thought that was correct and the paperwork was wrong ?
I can’t actually see any single point/person that has failed, just a catalogue of c*** ups and assumptions0 -
Anyone in a dealership can put the VIN into the system and see what the actual model is, regardless of what the V5 says.
