Car mis-sold by Audi dealership

Every piece of paperwork we have states it’s a 35. Again we were told this was because it was registered wrongly. We flagged this up before we picked up the car and we still have the picture of the car with the 40 badge that was sent before pick up. We were ASSURED it was a 40 numerous times. IMO, the price we paid makes no difference, that was set by the salesman. The issue is that we did not receive what we were sold. He obtained the sale under false pretences.1

You clearly found the extra performance of the 40 worth the extra money.
Did you not notice that extra performance lacking as soon as you drive your car?1 -

who was it that assured you it was a 40? the same rogue salesmen or various people in the dealership? if it was just the 1 salesmen
what's the outcome you are after, a straight swap for a new 40? unlikely IMO
the price is relevant.
is there a 40 anywhere at the price you have paid?0 -

The reference to it being "registered wrongly" is a bit odd as new cars are usually ordered (so there is quote and order paperwork) long before the car actually coming into existence and being registered at DVLA. Unless you purchased a "stock" vehicle, in which case the delivery is a lot shorter lead time and the vehicle may have been created (but not registered) in the DVLA system earlier in the process.
You have the picture of the car with the 40 badge.
Does the car actually have the 40 badge?
If your order states "35" then you were sold the 35 and did receive what you were sold. The best thing to do would be to have this normalised (correct 35 badge refitted) and the £1k goodwill payment and move on.

So EXACTLY what do you want to happen?
What would make you happy?
It's not good just being unhappy. If you do not like the Audi offer then tell them what you want & start negation's on that.
Clock is ticking 1 day left or you will get nothing as far as Audi are concerned.
Yes you count take them to court, but given everything you have said on the paperwork on the car & Audi offer. You may well end up losing.

I have a picture of the car with the registration that we ordered and badged as a 40. We will see what Audi head office come back with. Thanks for all the advice and comments.1
