Car mis-sold by Audi dealership

It seems everything in writing is a 35 but the conversation with the salesman are relating to a 40Hoenir said:

Everything on paper matches the car you've got, correct?
The price you paid seems to match the car you've got, correct?
Do you need the small amount of extra performance of the 40 over the 35?
35 = 150bhp, 270lbft, 135g/km, 139mph, 9.5sec to 60
40 = 190bhp, 320lbft, 137g/km, 150mph, 7.5sec to 60
Same basic engine in both, just the engine management mapping software is different.
How much time, effort, and blood pressure do you want to put into this?

Use the £1000 offer to get the engine rempped?
Then contact the ex-employee of dealer and ask him where you can buy the badge for the 40

Could this be, customer comes in to order a 40 spec car and the salesman see's a long order time, but there is a 35 with the same spec (other than engine) and sells that to the customer to get the sale and tries to cover it up when the vehicle arrives.
Would be fraud and the dealer would have to take the hit on the customer side and can deal with the ex salesman.

It was not a built to order spec and I think you could be right in your analysis of the salesman’s actions. The car is insured as a 35 as that is tied to the registration. No, we have not heard anything back as yet. I’m not sure what to expect and it’s not about the money at this point it’s the absolutely shocking antics of the salesperson and, subsequently, the dealership who don’t seem to be overly concerned and wanting to distance themselves from it. The 7 day offer is ridiculous - 7 days or what, do nothing?
