Car mis-sold by Audi dealership

    The dealership was telling the OP it was a paperwork issue.

    Everything on paper matches the car you've got, correct?

    The price you paid seems to match the car you've got, correct?

    Do you need the small amount of extra performance of the 40 over the 35?
    35 = 150bhp, 270lbft, 135g/km, 139mph, 9.5sec to 60 
    40 = 190bhp, 320lbft, 137g/km, 150mph, 7.5sec to 60
    Same basic engine in both, just the engine management mapping software is different.

    How much time, effort, and blood pressure do you want to put into this?


    Thats a lot of cash for a 150bhp slug!!  Only a premium badge could get away with charging that much for such a low powered car. I'd be asking for a 40

    As others have said - this is surely fraud.
    The salesman acts on behalf of the dealership - even if he is no longer there they should be resolving this.

    Playing devils advocate. 
    If all the paperwork suggests a 35. The car is a 35. The op is paying for a 35

    where is the fraud

    I think it's a waste of time escalating to Audi. It's an issue with the dealership and one of their employees. The dealership needs to make it right.

    I'd suggest offering to part-ex it with the dealership for a 40 on favourable terms. The issue will be the finance which is doubtless going to cost far more to settle than the car is currently worth, but that's not the OP's problem.

    I think if you had the 35 for a year before noticing it wasn't a 40, that you're obviously happy enough with the 35. 
    Given it seems to have been a 35 on the paperwork and the cost is correct for a 35 it seems you were sold a 35 that for some reason had a 40 badge on it.
    So I'd just take the £1k and keep the car for the remainder of the term.

    What does the finance company think it is? Because that may be the sticking point.
