I don't know if it is still the case, but every Audi I've owned had a sticker in the boot which gave the engine output in kW.

As the poster was buying the car on PCP would they not have a problem when they hand the car back to the finance company ,unless they pay the balloon payment and keep it , the finance company might insist it has to be the correct model .

I would think it's a good idea to inform the finance company what's going on.
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.

    Does the PCP say a 35 or a 40?

If op has been paying for a 35 and has a 35

If the op had been paying for a 40 but had a 35 it would be a bigger issue

op needs to decide if they are happy with the 35 they have and accept the 1k.

If op wants the 40. Needs to have that discussion with Audi but I assume there is going to be a wait where they will still have the 35 and be using/paying for it

Is your issue , and any compensation etc, not with the dealer if their employee has acted fraudulently?

As prices are always negotiable isn't it always a case of what was ordered and what was delivered that is important not the price.

Anybody buying a new car without going though the configurator and providing the exact spec to the dealer is inviting mis-communication and issues.

That said it seems the Audi tool is awaiting update to show the new A5 coming soon!

Have you been sold a UK stock or was it built for you?

If it was from UK stock then they should have provided a spec sheet and the VIN so you could review and confirm the spec was correct:

    Audi A5 Coupé

Black Edition 35 TFSI S tronic

    Hi everyone,

I was looking for some help or advice with the following problem please .

Last year (June) we got a new Audi A5 40 tfsi black edition on PCP from an Audi dealership. The salesman sent over the paperwork and my husband noticed that it was registered as a 35 tfsi which he brought to their attention.  The salesman came back and assured us that it was an error with the DVLA and took a picture of the car with the badge showing 40 which he claimed he hadn’t wanted to do before the grand reveal the following day when we were picking it up.

We collected the car and over the next several months, my husband kept in communication with the salesman over the paperwork error. He constantly reassured us and blamed the DVLA being slow to issue the correct paperwork. The last attempted correspondence with him was a few months ago to which we received no reply (turns out he had left the company). Cut to last week when we took the car in for its first service. My husband mentioned the ongoing issue and one of the people at the dealership suggested that they should put it on the diagnostic machine just to check if it was a 35 or 40.
Turns out that the car was indeed a 35 and not a 40 as it had been sold as.

After a few calls and emails, Audi have currently offered to change the badge and compensate us with £1000. They have told us that this was the work of a rogue salesman (their words, not mine) who rebadged the car. They also said that it was sold to us at the price of a 35 and not a 40 which we have no way of checking. This does not make sense though as why rebadge a car with a higher spec just to sell it at the same price as its original specification? From what I can tell, there is a much greater price difference than £1000 between a 35 and a 40. Also their offer will only stand for 7 days. Does this seem right or lawful?

Sorry for the long email but I was really hoping someone could point us in the right direction as to what to do.

    Many thanks in advance.

Last June, do you mean 2023 or 2024?

Did you not reject at source? Speak to the sale manager? The dealership owner? Audi UK?

As others have said your finance company?

It might seem that now after a 13 months that you are playing the game a little as you have had use of the vehicle for that time where you could have left it on their forecourt and told them to resolve it.

Also don't forget it's only an Octavia with posh knickers on!

Thanks for all the advice everyone. The car was purchased in June 23. All the paperwork has 35 on it but we were told this was because the car was mis-registered with the DVLA. Naive on our part but you don’t expect this kind of fraud when buying a new car. We have escalated things to the Audi head office in the UK and are now waiting for the dealership to respond to them.
