Car mis-sold by Audi dealership

I'm curious as to how a 35 had a 40 badge on it, because whilst I know you can order from the factory without the badges, I don't think you can order with the wrong badges. Was this a cancelled order for a badge delete 35 that someone at the dealership has stuck a 40 badge on by mistake? Was it a badge delete 35 that the salesman found a 40 badge for in order to push the sale through?The former would be unfortunately and the latter fraud, but if the OP has been paying for a 35 and got a 35 I'm not sure there's much could be done about it now, especially if it took a year to notice the missing 50bhp.If it was a fresh factory order and not stock, I've no idea how it could have gone wrong except for someone ordering the wrong car and trying to "fix" it later.Also, the time limit is up, did OP get @DT03 take the money or are they still arguing with the dealership?I guess the lesson to be learnt here is not to pay for the car until the paperwork is in order.1

I'd be worried if a car could get from the factory line to a dealership without someone noticing the badge was wrong. Maybe it's assumed to be so obvious it's not on any checklists, but they are German so I wouldn't bet on it.

Even if mistakes were made on the line, It cannot be ignored that going by the order placed OP got what they had ordered and signed for0

We are now well past the 7 days Audi gave & no reply from OP. Their last post was on day 7...
Or answering "What exactly do they want" Audi to offer them? Which has to be the argument to go back to Audi with.
Op has been driving this car over a year, so can take it that they are happy with it, never noticed the loss of a few HP.
So Audi offer of a new badge & £1K seems pretty good.

Update. Head office have been in touch and apparently they are still working things out with the dealership so we’re still waiting.To try and clear up some comments, the car has the 40 badge on it. With regards to us driving it away despite the paperwork saying it was a 35, we were obviously too trusting and the salesman took full advantage, fobbing us off for months (this is why it took 12 months for the truth to come out). We won’t be that naive again after this. My husband was never interested in a 35, only the 40 (call it midlife crisis or what you will, he never noticed the difference in output so… The point is that we were sold a brand new car under false pretences. The salesman did not make a mistake, he knew exactly what he was doing. It’s interesting to see the differing opinions on here, to which everyone is entitled to. Again thanks for sharing them.6

- They said they wanted a 40.
- The salesperson sold them a 40.
- They picked up the car with a 40 badge on it.
- The paperwork said 35 and the salesperson assured them it was in error and was to be rectified.
- It's not been rectified.
Audi and/or the dealer should put things right by ensuring the OP has a 40 model.6
