£50 in the bin quite literally

So I made the mistake of ordering from bodybuilding warehouse. Worse still, they use Evri. I was out when the said delivery was made and from what I've established the driver literally put the boxes in a wheelie bin. When I came home a few days later, I had the enviable job of going through every wheelie bin in my street to the delight or horror of my neighbours. Said package could not be found and this wasn't helped by the recent bin men visit!
So, I've tried contacting bodybuilding warehouse. They do NOT want you to contact them, they have a form on their page, no phone, email etc. No response. I thought I'd be smart and buy through PayPal. So, I raised a claim.
PayPal has just decided to refuse my claim as it was 'delivered'!
Where do I go from here, please...

The law says that BW remain responsible for the goods "... until they come into the physical possession of... the consumer".
See s29 of the Consumer Rights Act 2015 (legislation.gov.uk)
Evri putting the goods into a wheelie bin obviously does not satisfy this requirement so you are entitled to a full refund or a replacement.
You can contact BW on live chat or their website gives a physical address. (Or use the number provided by a previous poster...)0 -
As much as they try to resist this, this Bodybuilding Warehouse's problem to resolve. Despite what they think - they haven't delivered the goods you ordered until they're in the possession of either you or a nominated party. When goods are left outside the customers door (or in a bin, or wherever) this is done at the retailers risk and if/when - as has happened here - goods go missing before the customer gets to them, then this is the retailers problem. As an aside - I've ordered from Bodybuilding warehouse multiple times and never had an issue, so I don't know that ordering from this was a "mistake"1 -
I don't think anyone has suggested that BW are disputing this? The truth is that the OP hasn't had any response from BW as the OP doesn't seem to have tried terribly hard to get in touch with them.Ergates said:

Like you another poster has said BW have resolved this sort of problem satisfactorily in the past. Don't think there's any reason to expect they won't this time.0 -
Only great experiences with BW so I don't think it's fair to slate them because of a the courier and you being out for several days after delivery.Know what you don't0

Did the EVRI driver leave a card saying it was in the wheelie bin, and had you provided that location as your 'safe place' (I'm assuming you did not). If that is the case the item has not been delivered.

So to clarify, on the Evri tracking it notes my order as being 'Delivered' and there's a photo and 'GPS' coordinates as 'evidence'.The photo literally shows boxes inside of a bin. No indication which bin (there's a few on the street unsurprisingly) but that's good enough for paypal. I also didn't specify the bins as a safe place, in fact the only safe place is behind my front door!! I'll try and ring BW but based on the lack of response thus far (several days) it seems my prospects are not good!!! And I dare'nt try and complain to my bank/chargeback PP!!!!0

All they have to do is prove delivery. Which they can do.
If your PP acc is funded by DD, then there is no right to claim back anyway. Only if it is funded by debit or credit card.Life in the slow lane0 -

Where were you expecting the parcel to be delivered to in your absence?No, it's not ideal putting it in a bin, obviously, but did you tell them a safe place to deliver it to considering you were going to be away on the delivery date?You state that 'the only safe place is behind my front door', but you weren't there, and had gone away. Couriers are paid to deliver items, which doesn't necessarily mean inside your front door because, if that was the case, 99% of their time would be driving around NOT delivering parcels!People have to take a bit of responsibility for their actions. Ordering something and then going away from home for several days seems less than ideal, shall we say. Why didn't you wait to order it until you knew you were going to be there or, failing that, specify a safe place ?1
