In terms of a set aside ... I think this needs to be applied for within a "reasonable time" of becoming aware of the court decision - perhaps 30 days or so. (e.g. For defendants they may not receive court papers* and only become aware of the claim and default judgment when a debt collector appears, or they get turned down for credit because of a live CCJ). In this guy's case neither applies - he was well aware of the hearing and hence judgment, and he is well past any definition of a "reasonable time" since discovery.
* this is not a rare event in the Parking board, especially if the Defendant has moved house but the Claimant has served papers to their original address as was valid per DVLA at the time of the original PCN. (They're supposed to do an address check to confirm the D still lives at the address, but they rarely do).Jenni x3 -
Just a quick update.....I did not reply to the message I received. Up to now, I have not heard anything more from him. I got the new court threat on 30th May. Not 100% convinced this will be the end of the matter but I'll keep you posted. Thank you.24
