Gr1pr said:You don't do it yet, too early , I said next week, September
Your N1SDT claim form has the claim reference top right and the password is lower down near the money claimed boxes
You are not registering a new claim, you are acknowledging receipt of the postal claim pack ( but do it next week, stop rushing )0 -
Correct, next week is fine, or the week after, but preferably next week, a 5 minute task
Start drafting your defence based on the template defence by coupon mad in announcements, you are adapting paragraphs 2 & 3, preferably by reading a dozen recent similar cases to use what they wrote, for inspiration
And edit the woefully out of date thread title too2 -
Thank you so much @Gr1pr what's the easiest way to find defences of similar cases to adapt?0
-
Study the first 10 to 20 pages of recent threads, starting with this page 1 of the forum, or use suitable search word's and filter the results to show 16th july to present day
I rell most people to edit their thread titles to something more suitable, which when done helps people like you to find similar cases, which is one reason why I have told you too2 -

And use the Template Defence. It's already written for you and pinned at the top of the forum. It is easier than an appeal and - yes - DCB Legal will discontinue in 2026.Hope you are able to fit in the couple of hours needed to do the Public Consultation?

I've got a first draft of my defence below. Any feedback would be greatly appreciated (I'll spare you having to trawl through the other 9 C&P paragraphs)
3. The defendant denies all claims made by the Claimant. The Defendant has little or no knowledge or recollection of events on the dates stated. The vehicle is recognised and it is admitted that the Defendant was the registered keeper around this time. Referring to the POC: Paragraph 1 is denied. The Defendant is not indebted to the Claimant. Due to the operator’s system wrongly calculating the amount due, no valid contract was entered between the Defendant and Claimant. Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The circumstances of this case are that on exit the driver entered their correct VRM and paid the sum demanded by the creditor's and has a receipt as proof of this. NTK claims that the driver entered at 17:55, yet their later correspondent indicates 22:38 as the time of arrival. This contradiction clearly indicates a discrepancy between the operator's pay machine and their ANPR system. The Defendant is not liable and has seen no evidence of a breach of prominent terms. The quantum is hugely exaggerated (no PCN can be £170 on private land) and there were no damages incurred whatsoever. The Claimant is put to strict proof of all of their allegations.

Yes, all good except:
Remove the greengrocer's apostrophe:
"creditor's and has"
And explain to the judge what a NTK is (don't use an acronym you haven't put in full earlier) and sort out the typo (the last word is wrong):
NTK claims that the driver entered at 17:55, yet their later correspondent

Thanks @Coupon-mad. Is it beneficial to wait until the deadline (or at least near to) before submitting my defence or does it make no odds to the outcome or timeline?0
-
Wont make a lot of difference, but no need to wait when ready1

FIGHTBACK ALERT:
Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline.
See this thread:
We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.
I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.
Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.
CLOSES ON FRIDAY 26th SEPTEMBER.
