Ensure that DEFENCE is spelt correctly
Once submitted, start thinking about settling out of court or at mediation, so before court fees start being added
Any without prejudice offer can start low, say £30 or £50 but through negotiation might be agreed between £80 and £130 maybe
My reply above did already tell you that the offer "covers the court filing fee". Did you miss that? It's already in the offer.
There is no rush. Fees are not being added.
I did also tell you that £40 won't be accepted but it's a good starting point. They've only spent £35 on this claim.
DO NOT OFFER THREE FIGURES but expect to possibly end up somewhere near there.
I have submitted the Defence and recieved an acknowledgment from Claim response.
Thank you all for helping out.
I will let you know as soon as the next step is due.

We haven't discussed Mediation yet as the change is new.
But I do know (because I read about this daft decision) that the MoJ stopped short of sanctioning parties who don't make offers. You do NOT have to offer to settle and can't be blamed for that stance.
Just don't act unreasonably. And DO attend.

The justice system may want you to go to mediation, my point remains that you should be trying to get a settlement, regardless of mediation0 -
If you have the new N180 saying that Mediation is compulsory than you must attend. In your case it is different than our normal advice because the consensus is you should make an offer.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What form? I could guess at a Directions Questionnaire. Please be more explicit.1
