The NTK has no wording at all with regard to Pofa. Am I to assume then that ECP does not apply to Pofa?

No.  A POFA-compliant NTK doesn't have to mention the POFA.

There's no need to assume.  The question is which one does yours match when you do a straightforward 'spot the difference' comparison with the ones in my pictures?

You are currently struggling to use POPLA and know that it is not independent, and you were fobbed off at first appeal stage.  Your feelings about how unfit for purpose the current system is would be good for the researchers.

Attached. There is no "both sides" as email. Photos of the car "entering and exiting" were on the email (not included below).

That is not the NtK. That is the response to your appeal. We need to see the original NtK that was sent to you.

It is more likely than not, that it is the same as the supposed PoFA compliant one as shown in the thread mentioned by @Coupon-mad. However, even that one is not compliant with the strict requirements of PoFA as it does not include the requirement of 9(2)(e)(i) as there is no invitation for the keeper to pay the charge.

You stated earlier in the thread that Plan A was underway.  Where are you with that?  Who have you complained to in that context?

The retail park owner by email, a generic cannot do anything type response, if theres anything else on that front do let me know.
