Just a quick question before my hearing next week. This claim sadly had its defence written before I found this forum. I can attach a copy if anyone wants to read
Can I bring up points that I didn’t include in my defence at the hearing or not0 -
No, but you can say whatever you like about lack of prominence of terms & signs because those are issues covered by the CRA 2015. Section 71 places a duty on courts to consider fairness/prominence of terms and signage, whether a party raises it or not.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Does anybody have any pointers for valid points I can bring up about this sign at my hearing on Wednesday? This is the only sign included in DCB legal witness statement0

What are 'the terms and conditions overleaf'? Could be that the agreement is only valid for two years or something.
Where's the map of the enforced site?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
