    OK, so go and read the residential defence (yes defence) example(s) I've linked in the 2nd post of the NEWBIES thread.

    There's one about a tenant with a key fob.

    Use some of the paragraphs to put into your Witness Statement.  As an exhibit you'll need your tenancy agreement that shows there is no secondary contract of risk of a parking charge or a relevant obligation to display a permit (your defence did cover a lack of relevant obligation/contract).

    Also state the lengths you (hopefully) went to with appeals or contacting the managing agents to complain.

    Also evidence any medical condition of your child (or was it just average toddler meltdown?).  

    Evidence is key.

    so shall I submit a supplementary witness statement like DCB legal have done to add these points ?

    my toddler at the time who’s now 6 is medically diagnosed with autism and I have evidence of this 

    his meltdowns are related to his autism & are very extreme 

    I contacted the managing agent at the time who said to ignore PCNS as my tenancy agreement gives me right to park as a tenant. I never heard from secure a space after the PCNS were stuck on the car until court claim

  • Just want to know if there’s any valid points I can bring up at the hearing 

    will be printing copy of witness statement plus all exhibits including tenancy agreement and sons medical diagnosis 
  • I don’t know whether court listings are always up

    but the court schedule for my apparent hearing tomorrow isn’t showing my case. It’s showing 4 other cases at 10am. But not mine. Strange because I never received notice of this hearing and still didn’t get through to Edmonton 

    we shall see tomorrow will keep you posted

  • Is it possible for a claim to be struck out without a hearing ? Because now I’m wondering whether my claims been struck out hence why it isn’t showing as a listed hearing at Edmonton county court tomorrow

    Just logged onto MCOL. Makes sense that I didn’t receive hearing date. It’s been sent to my old address. What a joke. 
    Don't rely on anything on MCOL.
    Once a case is transferred to a hearing court, then no-one inside or outside the court service has any interest in the MCOL Claim History.

    In the absence of anything else, you must attend the scheduled hearing.
    I wouldn't draw any conclusion from the fact that your case doesn't appear on any list.

    Defo still attending tomorrow even though it’s not showing on court serve not taking the risk 

    can’t call Edmonton county court either as their closed 

    all shall be revealed tomorrow hearing at 10am

    It's probably been discontinued by the Claimant.  Sent to your old address.  Is it near enough to go fetch the post there tonight?  Might save you a wasted day and stress tomorrow.

    But MCOL doesn't show where hearing notices are sent nor anything about any letters sent by the local courts.  Nobody logs into MCOL after a case is allocated.  It doesn't get updated and doesn't tell you anything.
    I mean it is but I feel bad disturbing them. There will be new tenants in there 

    don’t they have to email me a copy too? Because I haven’t received any emails about discontinuing 

    I figured the hearing was sent to my old address because when I logon to MCOL & I pull the PDF up of my address from that particular claim it says all correspondence to be sent to and then has my old address
