    What I'm concerned about, is getting the migration letter to change to UC,  when at present I'm in the Limited capacity for work, but with my health problems which I have put in the Esa 50 form, I be forced to work. I have a chronic illness due to my previous part time job, which effects my lungd and a genetic condition which effects my joints. Autism. Fatigue.  I am wondering if they  will put me in the support group. But having to wait for them to look at it, is causing me anxiety.  Are they still going through the income related esa forms ? 
    You won't be forced to work with LCW but you maybe expected to attend work focused interviews. 
  • UC50 is the same as the ESA50 looked at currently by the same people. So I think regardless the outcome will stand. Just going to read your opening post.
  • What was your initial group you are currently in as you say' it's a review of current claim. But are you being assessed as your condition has declined and you believe you should be in the support group or LCWRA ? Have you submitted new evidence? Remember all of this is point scoring if you reach 15 points or fit into a regulation category then you will meet the requirements for LCWRA. Depends how chronic your lungs and joints are and evidence from a specialist to confirm this to me. Always fill the forms out about your worst days and copy everything.

    No no no no no. Please don't do that, that really is terrible advice. You should tell them all of your days. If you filled in the form based on your worst day and you had an assessment and it was one of your better days, they could think "well they aren't as bad as they said they were" 

    You don't need to be affected ALL of the time. It's at least 50% of the time.

    He may feel the same every day Poppy, we don't know his situation fully only what he's written and we perceive it to be. Depending on the information he has off a doctor or specialist he may have a paper-based decision. And you or I don't know each other's experiences on dealing with it. But I don't want to argue with you or derail the thread just trying to help this person. 
  • With my orginal Esa claim which I had to go to court to overturn fit for work and it stated Limited capacity for work by the Judge in 2019 With the Esa 50 I've sent in evidence about my copd, my joints, autism , mental health. This was this  January again I haven't heard back. My copd has got worse since Jan as I'm on different inhalers which is stronger.

    Ok so you've been on ESA LCW since January 2019 and an assessment form arrived in January 2024?

    And do you know what triggered the form to be sent out were you changing or reporting anything? So are you currently visiting the job centre to see an advisor once a month? You could also ask them to check if you have been waiting 9 months for a response.

    Can you also telephone your GP surgery to see if they have been in contact with them for any further information in regards to your condition?  As you sent lots of information regarding your claim and if your current condition is getting worse through stress waiting or anxiety ask to see a GP also. Nine months wait isn't fair but it does happen.

    Then if they have had no contact I would phone ESA and ask for an ESA 85 work capability report first or an LT54 decision makers report and if they state they don't currently have these forms to send out ask for an update on what the status your assessment is at currently as you submitted these forms nine months ago and the waiting isn't is causing you stress and anxiety. 

    I'm not sure how backlogged the assessments currently are I have seen people waiting quite a while or on a letter about payment rates the ( we looked at your claim again) and that sometimes is all you will see unless you ask for the reports I have listed.

    I currently have a broken arm and it's hard to type hope this helps you.


  • No I just received it , not sure why. I did read earlier posts that people had received them. Hadn't  been to the Job centre for a couple of years. I get Pip. And extra disability payment with my Esa. I used to do permitted work but gave it up in March 23 due to health problems. Had a phone call from Jobcentre just before saying they are contacting people again since lockdown

    Oh ok, so you were doing the 16 hrs a week permitted work and that finished 9 months ago  before the assessment form arrived due to a decline in your health. Did you let them know that you had stopped the permitted work or the people you were working for? It is possible your review was triggered by them sending something off to say you were no longer with them if they were being asked by HMRC 

    What is the extra payment with the ESA disability income guarantee?

    But do phone your doctor's surgery to see if they've been after information about your current condition.

    I must admit I don't see to much about stopping permitted work while on ESA LCW I assume it's classed as a change of circumstances to be reported by the claimant. But will look into that further.

    Did you do this below when you stopped permitted work or phone them? I think it could be that has triggered your review.

    It’s important to let the Department for Work and Pensions (DWP) know about any permitted work you do or if you change your permitted work. 

    To let the DWP know fill in a permitted work form on GOV.UK. Post it to the address at the top of any of your ESA letters.
