Moorside Legal court claim with 'parking fines' in the POC

    So they've had a hearing Order and you haven't. Did your address change since the claim form?

    You must URGENT, TOMORROW MORNING - ring your local court to find out the deadline for your WS because it MUST BE AROUND NOW. They've done their evidence bundle and you haven't done yours.

    Is their WS signed by a paralegal at Moorside or by an employee of the parking firm?
    Called local court and they said, both parties been notified of a paper hearing which was dated for 1x/05/2025 (already a past date). We genuinely haven't recieved this notification...we haven't changed address or anything.

    The person on the phone said, no need to send anything at this point, next step is the outcome.
    Is this a guaranteed loss? Anything that can be done at this point?

    Even on the MCOL the last notification is that the 'claim was transferred to BRADFORD on 1x/03/2025', nothing after this.

    All this effort for nothing......

    Did Moorside date their WS 2 weeks before the hearing but you only received it now?

    Any discernible date on their envelope?

    Wondering if - due to a clerical error at the court - they received both copies of the notice (yours too) laughed then posted the WS on time for the court but late for you, making it impossible for you to learn about it in time.

    A loss is ruled for us, having to pay £100 + £85 fees within 28 days.....
    Nothing to be done at this point right?

    Pay Moorside in full ASAP,  to avoid getting a CCJ recorded 

    That figure is a tropical loss total,  presumably a lot less than was claimed by Moorside on the claim form 

    Even the original pcn was £100, so they haven't profited from the claim

    Was the judge not swayed by your first point when you explained about the authorities of Chan and Akande that mean the claim should be struck out?
    There was no remark about this or anything regarding the defence.

    Potentially the judge deemed it to be ‘De minimis’ (a forum favourite) given the basis of the claim would have been detailed in previous correspondence.
