We really don't want to go to court so if this might end up there and thats the only way winning it, than probably better if I pay?

Countrywide's NTK is already featured in the NTK Images thread I started recently.  It says whether each one is POFA or not.

We would try and appeal, using Plan B template, adding a line that since the NTK is not PoFA compliant, the keeper cannot be held liable. We wouldn't identify driver.
    Nope.

IGNORE IT ALL, AND £170 DEMANDS.

     :)

Is the only way now to go to court?
If you could help out we would greatly appreciate it.

I'll take you to court if you don't pay me £170. Are you going to pay it because you have no idea about the process?

Why on earth would you consider just paying it out of fear of the civil legal process?

Eh?  Why would a defendant pay in full now, acting as if there's some kind of urgency (which there isn't) when:

    1. Mediation calls are compulsory and if you really want to fold, then fold then, for half the money or less?

    2. By refusing to settle at the Mediation call (which is our STRONG recommendation) you are likely to pay nothing at all, and

    3. even if you did have a hearing (unlikely to go that far) and were unlucky enough to lose (unlikely) you'd pay LESS than the claim?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Aright this makes sense to me so far. Thanks for that.

We don't want any legal case because of the type of workplace, should have no criminal record at all. However Im not sure if a case like above would go on record at all, civil legal process?

As I understand it, I should be looking for Mediation call as a next step. Never done anything like it, don't know where to start to be fair. I'll try and research.

    Any advice very appreciated.

Before Mediation call should I still send an email or letter written with the help of the template to them?

I removed the part with the increased amount as its not increased just yet, they're still asking the original £170. EDIT: Im wrong, original was actually £100, discounted to £60, so I'll add that section back in.

Our address didn't change since, is there point to write the "I confirm that my address for service for the time being ..."?

    Dear Sirs,

    Your Ref. ############
    Proposed Legal Proceedings
    Claimant: xxxxxx xxxxxxxx Ltd

I refer to your your letter of claim.

I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:
    [Correct address here]

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

Don't send me your usual blather about that.
I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully

No effect on you at all, not even if you went all the way to a hearing and lost.  No CCJ because you'd just pay whatever the Judge ordered. It's certainly not a criminal case either.

It is nothing to worry about but there's a procedure to be followed, exactly as explained in the 2nd post of the NEWBIES thread.

If you are only at LBC stage why are you even thinking about Court Mediation phone calls?
