  • Yes. However, a complaint was sent to CPS Midlands and this is their response.

Should I just wait to see what BPA send back?

a complaint was sent to CPS Midlands and this is their response.
But the complaint isn't "about TNC", as I said to you earlier:

And your complaint is not against TNC.  It's against the parking firm for letting their agent send a misleading letter.  Use my words from my earlier reply.

You have to complain to the PPC about THEM and then to their trade body.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • So do I respond basically telling CPS Midlands I am complaining to them about allowing their agent to send a misleading letter or have I scuppered that opportunity now and just wait to hear back from BPA?

CPS (Midlands) are not in the BPA AOS, they are in the IPC.

So the BPA won't investigate.  Maybe it does need a complaint to TNC who I think are in the BPA.

  • A complaint has been sent to TNC via their complaints form online.

However, their complaints policy does state complaints must be made within 56 days - a point that we are now passed.

I have also redacted my phone number but have left them with my email address to send correspondence to - this is still okay?

The below is the latest i have received - chances that they will “instruct solicitors”?

This was received on the 5th Jan, yet the letter states payment must be made 7 days from the post mark, which would give me a deadline up to the 4th jan - basically impossible.

That's nothing more than a debt collectors letter.

The fourth post of the NEWBIES thread explains exactly how to deal with debt collector's letters, but to summarise that post - ignore them.

Why are you bothering with these debt collector letters

That is all the more reason to (next) complain about TNC to the BPA. Several failures.

  • *update*

I’ve received a response to my complaint from TNC’s national operations manager.

It basically states: they have consulted their client (CPS) whom has sent TNC photos back to them of the PCN being issued to my vehicle for the following contraventions (D parked in a restricted area of the car park’ and ‘G not displaying a P&D ticket or valid permit’), the ability to appeal the PCN with CPS was not taken up within the 21 days of imposition, and as a result my complaint cannot be upheld, consequently meaning the charge remains due and unpaid.

Considering on BPA’s website that complaints are only considered once evidence of a complaint to one of their members can be provided, this is now the best time to go ahead with that - correct?

I can provide the email response I’m referring to first, if needed.
