I have a parking fine but not my vehicle

    Speculation, but I wonder if it was registered by the new tenant at that property.

    They'd see a name and address on letters that arrived after you moved out. And if they were less than trustworthy they'd be a prime person to see an opportunity.

    The V5C would have arrived to the right address, as would their insurance documents if they used the same address and called themselves the main driver.  I assume this car is showing as MOT'd and insured?

  • Consequently, you were the registered keeper on the material date according to the "official" records.
    Fortunately, the presumption that the registered keeper is the actual keeper is rebuttable (POFA paragraph 2(1))
  • So the vehicle was registered in your name by someone who knew that you had previously lived in that address. Do you have any suspects in mind?

    A possibility it is a known tenant with a dubious history of fraud, forging identities, and passing debt onto others, Not seen or heard from this person for a long long time since they tried to saddle me and others with a very large creditor debt. I have no evidence to back up it is them though, just the way my gut is feeling. What can I do?
  • You’ve already written to the DVLA telling them that you were never the keeper of the vehicle. Press them for a response if you don’t get one soon. 

    Meantime as you’ve filed your defence you won’t need to do anything for ages in relation to the county court case except fill in a simple questionnaire when the court asks you to. 
  • This morning I received a first email from a DCB Legal Ltd which corresponds with the company on the 1st document in this post from Civil National Business Centre - Met Parking Services Ltd on December 18th 2023.


    What is going on here? Is it normal to have the legal company suddenly contact via email before the CCBC has sent anything? I haven't heard anything yet from the defence i sent to CCBCAQ@Justice.gov.uk and i'm still waiting from the DVLA regarding my email explaining that I have never owned such vehicle.

  • This morning I received this letter from HM Courts & Tribunals Service (CNBC) which helps me understand where yesterdays email came from. I am wondering what to do now?
    - Do I provide dcblegal with a copy of my defense?
    - Do I ask them for something else?
    - Do I send them the DVLA vehicle request letters showing that I deny ownership of the vehicle and that I am waiting for DVLA to reply?
    - What do they want to know?

    CNBC has sent your Defence to DCB Legal. All the evidence you wish to rely on will be contained in your Witness Statement, to be submitted (usually) 14 days prior to the court hearing.  You're a long way from that, and given DCB Legal's involvement, you're unlikely to reach that stage. The Template Defence Announcement, first post, outlines the 12 steps you need to follow. Suggest you take a print of it and have it handy for when the next stage of the process kicks in
