I have a parking fine but not my vehicle

  • Peabody Hill is a development of houses, flats and apartments in West Dulwich by the Peabody Trust- there is free parking but there may be a permit system.  On google in 2022 I can't see any signs anywhere on the whole estate and there seems to be lots of parking available. 

    Peabody did use MET parking on some of their sites up to 31 Dec 2020 when they moved to PCM. 
    No idea what and where that is, i live near burnley lancashire all my life.

     It will most likely be them who contracted the parking company, and it is them who you need to contact to tell them that they must instruct their agents to discontinue the claim they have against you.
     It is also the peabody trust ( if it is them) who you must remind are jointly and severally liable for the actions of their agents and to who (peabody trust) you will be looking for in recovering your costs caused by their agents, the un regulated pakring company .
     
    dealing with the court claim should and must take precedence, however firing a quick shot across the bows of the landowner wont cause any harm, and may trigger a discontinuance plus let them know your intent

    I found peabody.org.uk via google, assuming they are the landownder, and sent them an email:

    In reference to the requested parking fine issued on Peabody Hill of vehicle XXXXXX on 00/04/2018

    I am not the registered keeper nor was I driving the car. 

    I have researched the PoFA 2012, which I realise does not apply at Peabody Hill. Peabody must cancel and erase my data, as I am not the liable party and I decline their belated request to be named as the driver.

    Had Peabody bothered to actually post the 'PCNs'  (original and reminder revealed in the SAR reply but which BOTH never arrived or existed) I'd have told them the above fact and they could have avoided this waste of time threat model.

    If you persist in processing my data and in the event of filing a court claim, take note that I will file a Part 20 counterclaim for not less than £500.  This will be claimed as damages for distress arising as a result of clear breaches of the DPA 2018 and/or the Protection From Harassment Act 1997.

    I will rely upon the case of Simon Clay v Civil Enforcement Ltd and similar cases that have succeeded.  Cancel the PCN forthwith.

    Improve your services to comply with the incoming statutory Code of Practice.  Groundbreaking improvements would include issuing future Notices of Parking Charge properly and engaging fairly, avoiding involving bulk litigators like MET Parking Services in this 'extorting money from motorists' model outed by the DLUHC as a market failure.

    It is not a fine. You should not be using words that suggesting it has an air of legitimacy. You haven't mentioned MET, and Peabody didn't issue the PCN nor the court claim. To whom are you referring when you say, "I have told them ... ?"

    I suggest you post draft communications here for checking before you submit them if the claim isn't cancelled forthwith.

    Just for clarity -- the DVLA won't be able to confirm or deny if you have ever OWNED a vehicle.

    They deal with vehicle registrations (amongst other things) and will only be able to confirm or deny if you have ever been the registered keeper of that (or any vehicle)

    Not really needed.  Advised you already it's not the DVLA which was the source of your data.
