    Hi Coupon-mad.
    No,haven't received anything from them. Hearing date is 28th Oct and WS had to be submitted by 28 days before the hearing.
    Mine was submitted on 28th Sept.

    Email the court and state that you have not been served with a Witness Statement or a Notice of Discontinuance by the Claimants so they are in breach of the Order dated xx/xx/24 and you wish to have your costs awarded when the Judge looks at the file and vacates the hearing.

    Attach your costs sheet, signed & dated.

    Copy in the other side's solicitor.

    Sit and wait...

    (if you have no costs then just do the above without asking for costs). Just ask for the claim to be struck out & the hearing vacated so you can avoid taking a day off work.

    Okay,sounds promising.
    So is the order the date stated on the Notice of Trial date  or of the actual hearing date?
    They aren't using solicitors apparently,was Elms but sent me a letter ages ago that they aren't being represented by them anymore.
    As for costs,it really is just my time which is really hard to quantify as it would probably be a week's wages at least and a day off work.
    Maybe easier to keep it simple even though it's carp what they do.
