Private Parking fine from UK Parking Control and Claim form sent from DCB Legal, What to do Next??

    Hi KeithP Thanks for replying, just reading this and its saying basically I sit tight and wait for a discontinuation right?? I received an email from DCB saying 'Without Prejudice Save As To Costs' which I'm assuming is the same to 'Without Prejudice Offer to Settle'?? Should I submit any witness statements or evidence to the courts?? Thanks

    Continue with doing your WS + Exhibits bundle, your court order gives you the deadlines, which are exactly the same deadlines for the Claimant and their lawyers too,  you should check with your local court if they have paid the court fee, AFTER that deadline but BEFORE the bundle deadline date, UNLESS the NoD arrives in the meantime, which it may well do before they have to pay the court

    Hi @Gr1pr Thanks for your message, it doesnt state any deadline dates other than the trial fee, which says... 'Unless the Claiment does by 4pm on the 21 August 2024 pay to the court the Trial fee of £27.00 or file a properly completed application....' The only thing i see is it says 'Each Party must deliver to the other party and to the court office copies of all documents on which that party intends to rely at the hearing no later than 14 days before the hearing. Where do I submit the WS and Exhibits bundle to?? Should I consult a local lawyer as this is not fully clear for me and I dont want to get anything wrong or jeopardize my situation. Apologies and Thanks for all the help

    The 'documents on which you intend to rely' are indeed your Witness Statement and your evidence.
    It also says you must deliver them to the court office and to the other party, i.e. DCBLegal.

    You know where the 'court office' is, don't you?

    You know DCBLegal's address, don't you?

    Anyway that is a bit academic... because you also know that DCBLegal will discontinue the claim before it becomes necessary for you to file and serve your Witness Statement and evidence.

    Its very simple, it tells you that the WS bundle must be submitted to both parties later than 14 days before the hearing date, so you take the hearing date and count backwards by 14 days, that simple maths tells you the deadline for the submissions, 18th - 14 = 4th. 

    You assemble your bundle. ( WS + Exhibits ) and email it as an attachment to your local civil court, the court mentioned on the court order, plus you CC the lawyers email address, plus your own email address too, so 3 destinations, including yourself, that way all 3 parties. ( Court+ lawyers+ yourself. ) each get exactly the same email bundle at the same time 

    No you don't need to pay a lawyer

    You do not need a solicitor.

    This is easy and nearly discontinued!  Probably before your WS deadline.

    Hey Guys

    Thanks for all your replies, obviously as you can tell I'm new to it all so apologies for the simple questions regarding this all. So from what you're all telling me is that I shouldn't worry and just wait for it to be discontinued?? Or do I still HAVE to submit my WS and Exhibits no matter what and then wait for a discontinuation?? In regards to my Witness Statement and Exhibits are there a templates available that I can follow to make sure I include key points to get across?? Again Thanks

    The NEWBIES thread has examples of WS statements and a detailed a-f list of recommended exhibits.

    Ok Great Thank You, do you have a link to where I can find the examples for the WS and exhibits at all as there is so much great info on the Newbies page but I'm just not sure which is right for the stage that I'm at.
