    ...non-POFA partly because it was sent far too late, and partly due to the same paragraph seen in the VCS non-POFA NTK which says wrongly (unlawfully, according to VCS v Edward) that a keeper can somehow be 'assumed to be the driver' (errr...no):

    Maybe not though.   I think UncleThomasCobley s post above has legs and needs to be tested at POPLA.

    (2)The notice must

    (f)warn the keeper that if, after the period of 28 days beginning with the day after that on which the notice is given—

    (i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and

    (ii)the creditor does not know both the name of the driver and a current address for service for the driver,

    the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;

    Warn and advised are different words and meanings....

    Countrywide Parking Management example NTK below. Not sure if it's POFA compliant or not? It doesn't explicitly state that they don't know the driver (legislation para 9(2)(e) ) but they refer to RK the whole time.

    That paragraph at the top of page 2 is appalling.  Page 1 also shouts about a CCJ too.

    Looks POFA compliant except for minor technicalities (such as not stating that they don't know who was driving) but I'd say a Judge would consider it a PoFA one.
