NSL at Stansted Airport
...wrongly saying that the registered keeper is liable under the POFA (this is not possible on land under byelaws, and has misled the clueless Assessors at POPLA).
The BPA are investigating a formal complaint I made:.
Cheap looking NTK; the back is blank I believe, with a separate page about appeals:
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Excel Parking Services Ltd
'non-POFA' NTK
...non-POFA partly because it was sent far too late, and partly due to the same paragraph seen in the VCS non-POFA NTK which says wrongly (unlawfully, according to VCS v Edward) that a keeper can somehow be 'assumed to be the driver' (errr...no):
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Subtle difference in the new words on the back.
Nov 2023.They now have a POFA compliant NTK:
(2)The notice must—(f)warn the keeper that if, after the period of 28 days beginning with the day after that on which the notice is given—
(i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and
(ii)the creditor does not know both the name of the driver and a current address for service for the driver,
the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;
Warn and advised are different words and meanings....

I see it but I'm not convinced a court would buy that. I wouldn't hang my hat on it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

non-POFA...
BUT:
This 2024 version has a paragraph about keeper liability, so this is trying to be a POFA compliant NTK but IT FAILS because the '28 day period' is stated incorrectly:
This one is completely non-POFA worded:
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Countrywide Parking Management example NTK below. Not sure if it's POFA compliant or not? It doesn't explicitly state that they don't know the driver (legislation para 9(2)(e) ) but they refer to RK the whole time.

That paragraph at the top of page 2 is appalling. Page 1 also shouts about a CCJ too.
Looks POFA compliant except for minor technicalities (such as not stating that they don't know who was driving) but I'd say a Judge would consider it a PoFA one.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
