Another reason why ANPR scameras are not fit for purpose.
In this instance, the use of ANPR has caused the EA 2010 breach because it requires a disabled person with protected characteristics to do something that an able bodies person is not required to do. That is discrimination.
The solution is to use foot patrols, and allow PCNs to be cancelled if a motorist is disabled but doesn't have a badge, or doesn't display a badge for some legitimate reason. Even requiring a disabled person to prove they are disabled and permitted to use an accessible bay is on dodgy ground. I'm sure I'm not the first person to hear, "You don't look disabled."

In that document you will see...It is clear from their recent correspondence that the NHS Trust again needs reminding of that responsibility.

Hi al, UPDATE.
We have sent this reply to PALS today.Thank you for your swift reply. Please see attachment below from the GOV.UK website which verifies that my fathers vehicle was parking legally in Princess Alexandra Hospital on the 6/Sept for a total of 55 minutes with his Blue Badge clearly on display while attending a clinic appointment for my Mother.I do need to state at this time the extreme distress this is causing my Father who has attended PAH on many occasions and has never had this happen before. He has been bombarded with threatening letters from the Private car park company CPP and the latest letter is titled "LETTER BERFORE COUNTY COURT CLAIM" this is causing undue harrasment to a 90 year old gentleman.I thank you for your kind attention concerning this matter.Kind regardsMandatory elements
Free car parking for those with greatest need
The current NHS Standard Contract [Service Condition 17.10] requires that NHS trusts and NHS foundation trusts:
- must comply, where applicable, with NHS car parking guidance
- in particular, must ensure that any car parking facilities at the provider’s premises for service users, visitors and staff are available free of charge to those groups and at those times identified in, and otherwise in accordance with, that guidance
The definitions of these groups are as follows.
Disabled people
A disabled person is a holder of a valid Blue Badge attending hospital as a patient or visitor or is a disabled person employed by the hospital trust.
Disabled patients and visitors receive free parking for the duration of their attendance at, or visit to, the hospital. Disabled employees receive free parking while at the hospital for purposes relating to their employment.
Frequent outpatient attenders
Parking will be provided free to all outpatients who attend hospital for an appointment at least 3 times within a month and for an overall period of at least 3 months. A ‘month’ is defined as a period of 30 days.
Contracted-out car parking
NHS organisations are responsible for the actions of private contractors who run car parks on their behalf.
NHS organisations should act against rogue contractors in line with the relevant codes of practice where applicable.
Contracts should not be let on any basis that incentivises additional charges, for example ‘income from parking charge notices only’.

WOW UPDATE.
THank you for all your help. we finally get there!!!"The Trust has agreed to cancel the ticket on this occasion.
However, please note that the area that the vehicle was parked in is for dialysis patients only which is sign posted on the entrance. On future visits please be mindful not to park here as tickets will be issued again.The Renal Unit, although on hospital grounds is not part of the hospital and they set the rules for their own car park.With regards to the blue badge, it was not registered with us so a ticket would have been issued also. This has now been registered. This will only need to be re-registered when your father receives his new badge or if he gets a new car"Kind Regards[Removed by Forum Team]
