Hi all, the keeper received a Claim form by post, and the address in the form is Money claims online, County Court Business Centre. He wonders if this is the small claim stage, however, it asked to make a payment of an amount more than £250.

The form includes 4 pages asking a financial detail about the keeper.

    Thanks for your support!

Having received a Claim Form, yes this is at the court stage.

What is the Issue Date on your Claim Form?

You need to be reading the second post of the NEWBIES thread.

There is no issue, just was surprised it came very quickly after the IAS refusal of the appeal.

But you do have a Claim Form, don't you?

    It looks like this...

What is the date in the box I have highlighted?

Yes it’s, and the date is the 13th feb, would he be able to ask for extending the period to 28 days to write a reply.

With a Claim Issue Date of 13th February, you have until Monday 4th March to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 18th March 2024 to file your Defence.
That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

May I know how you calculated the 14 days after the five days of services? as I calculated it for the 2nd of March.

Also, my friend is going outside the UK from 25th March to 14th April, and has a concern about the delivery of the court letter during this time.

But 2nd March is a Saturday.
No filing deadline will be on a non-working day - the deadline is extended to 4pm on the next working day.

Anyway, why does that matter? As I said earlier, there is nothing stopping you filing an Acknowledgment of Service anytime now as long as it's before close of business on 4th March.

@Coupon-mad You mentioned you should be honest with the judge about being the driver or not, so, how if in the whole process the keeper denied being the driver, would it be ok to say yes now?
