  • Hi there I received the Notice of allocation for the small claim track (hearing) and it includes these points that I didn't understand particularly the 7 days part. Can anyone please explain to me what the 7 days refer to?

    It's not important. It just gives both parties a right to object to the hearing order (but why would you)?

    The important bit is YOUR deadline to do your WS and evidence bundle you wish to rely upon. That's in the paragraphs above that.

    Paragraph 7 is just saying that the Claimant must pay the fee by the dated specified or the Claim will not proceed.

    Paragraph 8 is just saying that because the court has made the above points by itself, both the Claimant and or the Defendant can object to that decision within the seven days. I can't imagine why you might want to do that though.

    Thanks, both, the 7 days of receiving this letter have already passed, and I was just concerned I might have missed something.

    The deadline for sending the documents is the 23rd of September.

    I will be away from this weekend till the 22nd of September, so I have to send the documents by this Saturday.

    I wouldn't. That gives the Claimant a huge advantage.

    Prepare your WS bundle tomorrow/Thurs but DO NOT EMAIL IT until the 23rd.

    Is the hearing at Southampton or at Pompey?

    It's at Portsmouth. Ok thanks for your advice, at least this will give me more time to collect more evidence.

    Yes it's over. If you haven't received a copy of the N279 Notice of Discontinuance email the solicitor (or claimant directly if no solicitor involved) for a copy of the form.

    This is the only document that I received, I haven't received any document from the claimant.

    So write to the claimant and tell them to send you a copy of the N279 as they were required to do by the Court Procedure Rules (CPRs)
