Comments stage is in the NEWBIES thread third post but expect to lose.  POPLA is fairly rubbish.  Ignore their decision.

It's the 3rd post of the NEWBIES thread, a pinned sticky 'Announcement' thread at the top of this forum.

It's 2 clicks away; you already have 2 hyperlinks on this page.  My signature shows what the link at the top looks like.

  • @Umkomaas I went to the website to have a look but the only thing I could do on the site was to enter the details into the section titled "appeal now". Do you know any more about how to check? @Coupon-mad Does the fact that the POPLA appeal was done change any of the things you have explained or advised (aside from the obvious of not doing the POPLA appeal) ?

Does it not ask you for your PCN reference number and car's registration number?  It's more likely to be via their 'Pay your Parking Charge' (or whatever they call it), rather under any Appeal portal.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You now have to go through the PPC's POPLA evidence and rubbish any point you can this is done through POPLA not the PPC's website.
I have looked at reviews of the pub can't find any others complaining about parking charges, I believe your major error was mixing up why you had to register your vehicle, it was nothing to do with being a customer or a turn away it's about lazy anpr systems and greedy PPC's how on earth can an anpr know if you are a customer or not?
You need to debunk the signage claims by the PPC, they will have said no doubt that there were ample signs in the car park explaining procedure, terms and conditions and contracts.
GSV from June this year suggests not, and what signage there is suggests that a permit is needed to park so the PPC isn't actually offering a parking contract the signage does not mention anpr, or about registering and you must point out does not conform to the BPA COP.

  • @fisherjim Please forgive my ignorance- I/we have never dealt with anything like this so it is a little confusing. Can I clarify with you please:

"You now have to go through the PPC's POPLA evidence and rubbish any point you can this is done through POPLA not the PPC's website."
Do you mean this is what I need to do now, as they are asking for us to "comment" by Sunday?

"I have looked at reviews of the pub can't find any others complaining about parking charges" -
I looked too and was shocked to see none but I suppose not many people will go in and come right back out?

"You need to debunk the signage claims by the PPC, they will have said no doubt that there were ample signs in the car park explaining procedure, terms and conditions and contracts."
    Yes they did.

"GSV from June this year suggests not,"- what is GSV? I could not find it in ythe acronym list.

..."and what signage there is suggests that a permit is needed to park so the PPC isn't actually offering a parking contract the signage does not mention anpr, or about registering and you must point out does not conform to the BPA COP."
Shall I list these things just about as you have written them here, in my "comments"?

The sign they sent a photo of is this:

This sign does mention ANPR so I will have to remove that from the list of things to mention but you can also see about the "customer" suggestion. Is it worth adding that to my list of issues?

Thank you very much for your help...

There is no offer made to, nor 'relevant obligation' applicable to non-Swann Inn customers!  Nothing on the sign for everyone else!

I think you need to word it that due to lack of suitable food for a person with protected characteristics you had to leave and therefore were in essence, non-Swann Inn customers through no fault of your own and were never handed the VRM keypad nor alerted to it.  The signs outside were small and unlit and no agreement was reached and no term
breached because there is no offer made to (nor 'relevant obligation' applicable to) non-Swann Inn customers.  In short, the terms as drafted don't apply to the public at large.
