Strange fine and poor response

  • Very happy to name the pub. I was unsure if I was allowed to do so. It is The Swan Inn, Stoford just outside Salisbury.

I was also a little unsure despite reading the Newbie FAQ after reading other pages such as the page titled "Fight unfair private parking tickets" which suggests some things a little differently than the Newbie FAQ page. For example-

" Proof of mitigating circumstances. " which says to Keep anything relevant, such as receipts from a recovery company if you were broken down."  but the advice above on this post is to not try using mitigating circumstances as it wont make a difference.

Ha!  The difference is, we do this every day.  With the best will in the world - and they are listening and aware of what we do here - the MSE Forum Team and their journalists don't.

So, they don't seem to realise that the PoFA 2012 isn't mandatory and nor do they realise that the 'appeals' services (about to be replaced by the Government stepping in) are widely considered to be a kangaroo court farce.

Apart from receipts at some retail parks, any  mitigating circumstances are not considered.  It is wrong of MSE to tell victims to appeal telling the story of what happened. Don't read that!  It wrongly makes people think there was an appeal. There wasn't, in our experience.

And it doesn't seem to take account of the fact - IMHO - that almost all private PCNs are unfair, not least due to the extortionate amount (that the DLUHC is also likely to be ending next year, in most cases).

    The Government knows...!

We've tried hard to improve the MSE 'Guide'.  It is a tad better than it was years ago.

You'd win in court. Unclear signs.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They deserve to be named and shamed.

Have people said the same in TripAdvisor?
    I'd be surprised if not!

    Leave some scathing reviews
  • I know it doesnt make any difference to this situation but I did note that on the pub website's ABOUT US page there is a link to payday loans which I thought was odd.

Have you told this story to the local press?  They love this kind of thing to fill in a no news day!

Press coverage on google (you have to trawl to page 7/8) of the closure of the pub by previous owners suggests it is owned by the Ei Group (part of Stonegate) - 'Pubs are either tenanted or managed. Pub chains such as Punch Taverns and Ei Group own thousands of tenanted pubs which are not branded to retain uniqueness. They are controlled in the brands of beer, ales and lagers and sometimes other beverages that they may sell.'

  • Sorry- I have just realised I've made a mistake and given you some incorrect information. We did "appeal" but I thought it was just the appeal on CEL's orignal "invoice" letter but now realise the POPLA appeal was also done. POPLA replied with "evidence" sent to them by CEl and have said we have until Sunday to "make comments" on and they then make thier decision. The "evidence" is what I mentioned above, a photo of a sign, list of other vehicles, photos of our vehicle and documents showing "Parkingeye vs Beavis". I can show you al that was sent, minus personal details, if you would like but you sound like you already know it inside-out. :)

If they have contacted CEL with the vague possibility of a cancellation, periodically check the CEL website for the current status of your PCN. Try to stay one step ahead.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
