    I have advised before that Defendants write to the CNBC and object to the black hole that they let stayed claims sit in forever, and tell them that your address for service is only good for 2024.  Not later.  After that, should the Claimant attempt to lift the stay, you require that this email is placed forever in the file and must be read by the Judge and that, with the Overriding Objective in mind, the Claimant must be ordered to check the correct address for service (and provide evidence of doing so) before the stay be lifted.

    I have been advised by a district judge that it is best to just leave a stayed case dormant. If the claimant were to ever try and lift the stay, it would cost them £303 to simply apply and then they would have to convince a judge that they had a very good and compelling reason for not applying to lift the stay sooner. The odds are that they would be refused and the case would be struck out.

    Even the intellectually malnourished eejits that operate these scamming companies are not going to risk £303 on the very unlikely chance that the stay will be lifted. Just let it rest in peace.

    Ah really? ok, thanks for that!

    I was a little worried that if I moved address and if the court sent me anything and I didn’t respond I’d potentially get a CCJ!

    There is an extremely remote risk that they would try to lift the stay and resurrect the claim. I mean almost zero chance. However, as long as you can remember to send them a data rectification notice if you do move, then that risk becomes zero.

    The Judge is wrong. Obviously it wouldn't cost £303! That's the fee for an application with a hearing.

    Advice about how to do that, in fact how to do everything/anything, is in the NEWBIE sticky but, in essence, send a DATA Rectification Notice to the DPO of the relevant PPC, whose e-mail address is (or should be) found on their privacy page but to save you searching, it is: -

    Thank you! And I assume I keep a hard copy of the email somewhere too? Just in case they said I never sent it, etc?

    Do I do the same for the courts to update their details on the case too?

    Send it to yourself as well (if you do move) that way there is proof that, if you received it chances are so did the PPC.  As for court - I don't know but what harm can it do, assuming they keep your name and case particulars on file somewhere.
