Thanks for the fast reply. To be honest I'm totally new to this forum stuff so dont even know how to start a new thread. I googled for advise on CNBC claims and stumbled upon it. I have found it very helpful and submitted an acknowledgement of service. I have found the defence template also.

In my browser there's a red circle with a "+" in it down near the bottom right corner.
  • Hello  hello, can somebody help me please.
have a CNBC letter for parking eye.
It is from my place of work, i do not even remember.
Should i just use the template as explained in the newbies thread?

Please start a new thread of your own, after reading the 2nd post of the NEWBIES thread. We'll help after that!  But not here.

You didn't watch the forum navigation video about starting threads, offered when you registered?  In the welcome email?

I suspect it's under "help" or "forum help" which I think is probably listed under the three horizontal lines (top left of every page).  You are trying to run before you've watched the video re how to walk round the forum!

    Hi all.

I wanted to provide an update, but unfortunately, there isn't one yet. I've just logged in and found that the claim history remains unchanged, with no new information from them.

This claim dates back to August/September of last year. Does anyone know how long it typically takes to receive updates or learn about the next steps?

The claim will be stayed. If a claim is stayed due to the claimant's inactivity for over six months, the defendant can take steps to have the claim struck out. Here are the relevant details:
    1. Application to Strike Out: The defendant can apply to the court to have the claim struck out due to the claimant's failure to respond, which may be considered an abuse of process. This is done under CPR 3.4.

    2. Court Fees: There is typically a fee associated with making an application to the court. The fee for an application to strike out a claim without a hearing is £119.

    3. Grounds for Striking Out: The defendant should outline the reasons why the claim should be struck out, such as the claimant's failure to respond or progress the case for over six months, which is seen as an abuse of process or an indication that the claim has no merit.

    4. Claim Stayed: If a claim is stayed, it means that the proceedings are temporarily halted. The court may require action from either party to lift the stay and proceed with the case. If the claimant takes no action, the defendant can move to have the stay lifted and the claim struck out.

    5. Seeking Costs: When applying to strike out a claim, the defendant should also request the court to order the claimant to pay the £119 costs incurred by the defendant in making the application. The court has discretion to award costs based on the circumstances and the conduct of both parties.

To summarise, the defendant does need to pay a fee to apply to have the claim struck out, but they can request the court to order the claimant to cover these costs if the application is successful.

Or let it lie, but tell the CNBC and solicitor if you move house.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yeah this is my intention. I don't want to be paying over £100 even though I can get it back.

    Thanks.

Thank you very much for this. Do you know if eventually it will be strike out naturally, if they have not responded? Or could this potentially sit here for years?
