So if you weren't authorised to park you were trespassing and no contract could be formed with a two bit parking company.

Yep, appeal based in no consideration period.

No paying it, even if you lose at the farce IAS.
    As above...
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • IAS even make it so you cant copy/paste into your appeal box...incredible
  • You also cannot copy links (the IAS consideration period link for instance ) into the IAS appeal box. There is a lot of programming behind that box to make sure you have a tough time

  • This was the response from IAS below this paragraph.
FYI I was in the car the whole time so they have that wrong and still, it was only 4 minutes.
I have the options to respond or "refer the case to arbitration", Id think responding of that the information they stated is wrong, the driver never left the vehicle for 4 minutes, and left immediately after rejecting the t&cs

The Operator Made The Following Comments...

Difference of Consideration Period and Grace Period
A consideration period is a period of time at the beginning of the parking event. This is to enable you to look at the signage etc.. and decide if you want to accept the terms and conditions of parking which is offered.

A grace period is 10 mins at the start or end of a pre-permitted period of parking. For instance, if a motorist has brought a pay and display or cashless session, you would have 10 mins to comply with the terms and conditions of parking or after it has expired for you to exit the car park.

Any individual who is eligible to drive are required to be safe and have the ability to use a combination of knowledge. They also would require skill and attitude to drive, and they must also accept the traffic laws and driving practices.

The Protection of Freedoms Act 2012 (for tickets issued after 1st October 2012 in England & Wales) now results in the registered keeper being liable to pay the charge if they are unable or unwilling to provide the

The vehicle parked on site picked up a passenger highlighted in red in the photos and then left site. It is the driver's responsibility to ensure that the terms and conditions of parking are complied with. The vehicle was secure, stationary, and unoccupied and was not pre-authorised and therefore, in accordance with the advertised terms, the driver is liable to pay a charge. The signage on site complies with current regulations and is sufficient to have brought the terms of parking to the driver's attention. The signage is neither misleading nor unclear. The contractual terms require the driver to be pre-authorised, otherwise by parking they agree to pay the charge. If for any reason the driver cannot be pre-authorised, they can either park elsewhere, or remain parked and agree to pay the charge.
  • I was driving through the one way system - is the fact i picked up my friend even a point to consider?
