    Reply back from the court, and I quote...

    "Mediationm for this claim is still volunatry" (sic).

    I've also had a confirmation e-mail that my mediation appointment is cancelled. Game on.

    So, if you have an 'older' (before May?) claim in against you, question the court if mediation is being forced on you (especially if you were clear about the matter in older versions of the N180 form).
  • Well, delighted to report that this one is still ongoing.

    Received a letter today from the allocated court that states that by order of the court that the case be transferred to my nearest County Court as the case is 'being the incorrect location for the parties'.

    Not that it really matters that much to me but is my assumption that I had the right for the case to be heard at a court of my choosing/preference incorrect?

    Yes.  But it is moved to that court now?  All good.  Remind us: is this an Elms Legal claim or a DCB Legal claim?

  • The court initially selected was one thought to be one of the more favourable in these cases in my vicinity.  The court to which the case has been re-directed is the one just about closest to home.  I'm not particularly concerned, it just seems odd to have had no communication from the court to enquire why the case had been sent there - they may have been a very good reason for the case to have been sent there.

    The case was Elms but like many others, VCS ditched them and all subsequent communications is direct with them.

    Am delighted to report that I have received notice via mail that my case has been scheduled to be heard in early December, with witness statements etc. being required by early November.  I will proceed as per the abundance of information elsewhere on this forum.

    Quick question regarding additional directions.  The claimant has been ordered to provide what appears to be a decent amount of evidence to both the court and I by the same deadline by which I must submit my witness statement.  Some of this evidence was already provided at the IAS appeal stage such as site layout, signage etc. and due to their ineptitude, actually provides me with yet further evidence to counter the primary arguments of their claim.  I'll proceed on the evidence that they have already supplied - if the evidence they provide was to change substantially, how does this affect my case/defence? I'm obviously working on the basis that this information will not be made available until the very last minute thus not providing me with the opportunity to further build my defence on what they have provided.

    Also, if anyone could provide me a link to the thread which discusses a similar keying error case which was struck out by a judge in Bradford sometime earlier this year, I'd be very grateful - I thought I'd bookmarked it and now can't find it for love nor money...

    Yes we have seen that before.  From a certain court area (can't recall which) who are obviously fed up to the back teeth with parking claims being so badly pleaded and are hopefully going to be on your side.
