The Independent Appeals Service (IAS) is administered by The International Parking Community, IPC. IPC is operated by Will Hurley, in the past Director of Gladstones Solicitors. Gladstones Solicitors, directed by John Davies, operates in debt recovery, often working with private car park operators to collect unpaid parking fines, offering specialised litigation service. John Davies was previously Director of IPC and currently sits in the The IPC Steering Committee. Everyone reading can reflect and come to own conclusion about the professionalism and reliability of this whole procedure. I don't see anything "professional" in all this chain.
Given this, if there's still time for that, I would make anyway an appeal via full IAS procedure, knowing that it is a farce. Just to highlight later in a defence how the whole chain is compromised. I suggest to proceed with it also to just waste the time of the pretty dodgy characters who run these companies (maybe ask your MP to complain to PPC and IAC).
I believe IAS doesn't consider mitigating circumstances, that's something for the parking operator (in theory, in real life as we all know normally all is dismissed/ignored) and the landowner/managing agent. The "independent" appeal service IAS intervenes for breaches of the Protection of Freedoms Act 2012 and the Parking Code of Practice signed up by the operator, so the document sent to them has to be well made with a strong legal case.
Few months ago, my appeal to IAS ended with the PPC dropping the case their side before "judgement" from IAS and dismissing the ticket, after I sent over a 20 pages document with multiple breaches of PoFA and CoP reported with all the evidence and detail possible.0 -
Just as an update, VCS Ltd came back to me re: my appeal with some waffle about them being in the IPC, they've followed their Code of Practice, that's all they need to do yadda yadda yadda...

The International Parking Community - a horrible little collection of companies whose operations are at best, questionable. A collection of companies who decided that even the relatively lax oversight of the British Parking Association was too restrictive for them and their immoral behaviour. The "who's who" on the IPC website really does look like a true rogues gallery.We've got United Trade and Industry Ltd who trade as The Internationally Parking Community, The Independent Parking Committee and the hilariously titled Independent Appeals Service. Yes, I am calling out this appeal process and everyone associated with it. Those involved should be ashamed of themselves, especially those of a legal background. It isn't independent and your antics are well-documented. You make up shoddy rules, apply shoddy rules and then judge on your own shoddy rules. I knew before I even started this appeal what the outcome would be - the ability to say my piece has however been quite cathartic. If you are so sure of your high standards and practices, why don't you open them up to truly independent scrutiny and judgement? I think we know the answer to that one...I tell you what, let's call this quits by using your logic:By responding to me further concerning this matter with the objective of pursuing your speculative invoice that you think I owe you money for, you are entering into a contract for my time and agree to pay me GBP100.00. Nice but you're dealing with the intellectually malnourished. Some of the words in that letter won't even compute. I fully understand the cathartic value of it though.2

Just to give an update to where things are with this one...
Went back and forth with the IAS appeal. I was quite pleased how long I was able to string it out! I then made the point that I had parked at the same car park later that day which they confirmed that indeed I had. I then asked for the times of entry and exit for the later visit as I wanted to check the accuracy of the times on their camera.
And that's where things went quiet.
And that's when the case was automatically sent for arbitration to one of the IAS goons. Thing is, their 'rules' allow an operator to not reply to a valid request and after so many working days of silence from the arbitrator, the case gets sent for arbitration irrespective of any outstanding requests from an appellant. Calling the system run by the clowns at IAS a 'kangaroo court' is quite unfair on kangaroo courts!
Unsurprisingly, the IAS appeal failed (a load of legal waffle).
Today, I was delighted to received my first demand for £170. Lovely red writing. As I've said before, I'd really like this to get taken to court as I would hope no court in the land is going to side against an individual who has in good faith paid for the service used - anyone know how many of their fake demands are sent before they start with court proceedings?

You could try posting the demands back to them without putting a stamp on the envelope. Invariably they will receive a notification from Royal Mail that there is post for them but they must pay something like £1.20 (or whatever the postage and admin fee is these days) to receive it. If they are inquisitive enough to want to know what is waiting for them in the envelope (greedily anticipating a cheque from a victim), they must fork out to receive it.
