If the NtK was PoFA compliant then just use your first para. There is no need to go into al the date and time stuff as it is already stated in the PoC.

Honestly, a simple "The defendant parked at the xxx car park and paid the parking fee which can be evidenced and was acknowledged by the Claimant". The judge will be busy and will appreciate a concise defence point.

None of us here like these parasitic, intellectually malnourished scammers. When you win, you can rest satisfied that it has cost the ex-clamper thugs much more than it has cost you.
  • All I want out of this is an example to others that the big scary letters are to be challenged and a few quid in costs to donate to a charity of choice to those who've helped.

Quick question re: court acknowledgement.  What constitutes a successful acknowledgement/filing of a defence?

I submitted my document yesterday morning via e-mail as per the thread instructions also asking for an acknowledgement .  I received an automated response immediately stating I should get a response in 10 days.

The online system now shows this screen.  It looks different to yesterday - no space for a defence and there is that strange 'Delete' button with no explanation.

I'm currently on hold to the CNBC to get an answer but I've been on hold for 40 minutes....

Has anybody had a similar experience and what was the outcome?

Just to bump this one back up as my deadline for submission of defence is tomorrow and I've been unable to speak to a human at the Business Centre...

Another thing I've noticed is that in the Response History on the page after you login, under Latest Document, it states 'Defence'

Would it be reasonable to assume my defence document has been received?

    Thanks in advance!

Me! :D I got to name the case for personal reference and thought that most accurately described the situation.

    LOL, that's so funny.  Perfect.

The thing is, we don't know about this new MCOL history dashboard as it looks like they changed it recently.

But if you've emailed your defence to the right CNBC claimresponses email and you got an acknowledgement, then it's safely in.

Great stuff, thanks as always @Coupon-mad - I got the auto acknowledgement within seconds of sending so fingers crossed.  What the worst that could happen?  They could take me to court....  :)

    Yep.

Worst is a hearing, you lose & get ordered to pay... likely less than the claim.  That's it...!

Right then, a bit of info that may be worth highlighting somewhere for others - @Coupon-mad ?

After holding for 1hr and 10mins, I eventually spoke to a nice chap at the call centre who told me the following information after an initial panicked conversation as he originally didn't see the defence as filed (but he was very keen to help and get it sorted there and then).  Only when I mentioned the e-mail submission did things become clearer/simpler.
    • Unsurprisingly, the court system is completely overwhelmed
    • claimresponses.cnbc@justice.gov.uk is the correct e-mail
    • An automated response e-mail citing 10 days etc. etc. is acknowledgment of receipt
    • The act of sending an e-mail puts a block on the case being automatically sent for judgement without a defence
    • The e-mail goes into a big pile/backlog for manual assignment against the case and eventually it'll get married up
    • One other way that you can see this is on the moneyclaim.gov.uk under the details of the case - note the text highlighted in yellow.

Hope this is of some use to anyone at that stage of the party.
