Help needed: multiple tickets in a row for parking outside my own house

    Thanks for this, can you confirm, are streets a, b and c under common ownership / management?

    You say there is only one "estate management company for the entire estate regardless of which party owns the land."

    If so this suggest to me a deliberate attempt to exploit. Corner the residents into a small space and pick off the weakest (last to park). Nasty.

    I’ve not followed the links Coupon Mad gave you to read - so may duplicate advice here.

    You must go back to your lease / tenancy agreement. What does that say abut parking? Prior to that what led you to consider living here? what was advertised? What did the offer include? (such as free on street parking).

    Seven years is not enough to create a new right to park, but was that right included in the initial offer? Even if it was not in the signed contract was it included in the prior negotiated terms and conditions?

    Has there been a variation in those terms and conditions without a residents vote?

    I’m driving towards a derogation of grant, A breach of contract by your landlord (or their managing agents (jointly liable)).

    2. I will check my lease and get back to you on this.

    3. We were entitled to our own private allocated space each (this is most definitely in the lease), and plenty of off road parking on the estate for residents and visitors alike (this was a verbal sales pitch / promise) and at the time I believed them, because the estate was half-built and there was plenty of space everywhere. Then they've started building more and more flats without sufficient parking. Those residents simply parked on the other roads of the estate and that's how it all started I believe.

    I believe their objective is to introduce parking restrictions throughout the estate, completely banning parking on unlined roads so that they can make money out of us. There are only a couple visitor bays for a block of 18 Flats (our building); needless to say this is not sufficient, and with new restrictions no visitors will be able to park on the estate (anywhere within a mile radius)

    They did mention that this is only the initial phase.

    4. I am not aware of any variation of terms and conditions. Who would I need to ask about this? The management company?

    I can now confirm that the same management company that implemented the parking restrictions on road C is responsible for the estate-wide matters (i.e. parking, landscape etc). However there are different so-called "block management" companies which deal with smaller sub-divisions of the estate (i.e. building repairs etc). 

    I have looked at the lease carefully and I have found a couple of references which I felt were relevant, please see the attachments:

    I have now had all of my appeals rejected (one letter for all of them), and I attach PPM's rejection letter below. Note that I have obscured the names of the Landowner and the Block Management firm. They responded to my initial appeal where I moan about the fact that neither the Landowner nor the Block Management Company were aware of this.

    Where they say that "so & so and so & so" are not out clients" ...does that lead you to realise by a process of elimination who is behind it? Someone signed that contract.

    Anyway apart from the MP and local press push you must now IGNORE PPM.  Do not try IAS as it is a kangaroo court.  Ignore.

    Come back in 3 weeks to see what wise words the Government might include in their published draft Impact Assessment (due this month) as this rogue industry is finally dragged kicking and screaming towards proper scrutiny and statutory regulation.

    All useful stuff for the MP and the press.

    What do you all think about my chances in court given all of the information that I've presented?

    Do you still think that it is winnable, or, if I were to lose: the total amount I would have to pay out reduced to something more reasonable?

    I am happy to fight on. I just want to be sure that given all the effort and the anxiety involved that I come off better in the end.
