    Thank you for your advice.

I have been issued 7 in total. Three of which have come through the post, but when I called them they told me I had four more in the works.

I feel like they've purposely chosen to not slap PCN's on the windshield so that they could maximise their profits. Had people seem the tickets they would have stopped parking there.

Several other residents are in the same position as me, so I will share this advice with them.

Get your MP on board to make complaints to PPM, the IPC and the landowners.  That works.

And get it in the paper, like this:

I am a little worried that the costs (including the court costs) may balloon beyond what I can afford to pay should I lose in the end. What are my odds here?
We see 99% wins and we know what we are doing.

There are no high costs at stake; you don't pay solicitors' costs in small claims. I bet you imagined hundreds in costs. Wrong.

Why do you think we do this every day? No-one is put at risk of CCJs or ballooning costs and even the odd person who loses in court pays LESS THAN THE CLAIM!

    No CCJ.

Here's a typical win from today already:
    https://forums.moneysavingexpert.com/discussion/comment/80144190/#Comment_80144190

Yesterday we had three out of three!  About half of cases are about scam operators at residential sites with not enough notice and poor signage.

Please tell your neighbours this.  They can copy & paste our resources, it is easy.  We defend parking claims EVERY DAY on MSE. There's no risk, especially given the direction of travel of the new law. Huge changes are nearly there.

The Government is believed likely to ban the fake added 'debt recovery fee' (£60 or £70 per PCN) and that will be announced in July!  This will stop court claims in their current bulk.

The DLUHC banned it in 2022 but it's a long story.

Please publicise with your neighbours when the DLUHC's Public Consultation opens next month AND mention it to your MP when asking them to weigh in.

The Consultation is coming out in weeks and we need ALL affected to drown out the responses by parking firms!

I really appreciate this, as I was losing all hope in justice. £700 worth of fines for parking outside my house where we've been parking hassle free for 7 years, and the manner in which it was executed is disgusting and immoral.

    thank you so much

Are you a freehold owner, or leaseholder? What do your deeds say about parking? Did the managing agent conduct a consultation as required by the Landlords and Tenants Act 1985 before the imposition of P&PM?

@Mouse007 is well versed on parking at residential sites, and I anticipate they will contribute shortly.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You won't be paying anything. Spread the word.
Get your MP on board rattling these 3 cages:

    - the parking firm
    - the IPC
    - the landowners/property agent

Did you read the newspaper article I linked?  REALLY SIMILAR very recent case where the property agent has stopped the enforcement due to the complaints and an MP weighing in.

I am in the process of compiling a letter to my MP.

I will look at the link you've posted now.

Thank you, it gives me hope and energy to fight.

Leaseholder, but there are also freeholders on our street who got hit all the same.

You realise they can't do this to leaseholders and freeholders?  You all have primacy of contract - almost certainly rights and easements.

Do stop ANY neighbour from paying.  Call a meeting and update them with your progress and tell them about the Govt Consultation in a month where they ALL need to respond.

How many years have you lived there?

In any case, you and your neighbours may also get some mileage out of Saeed v Plustrade Ltd (2001) and Pace v Mr N (2016)

I can see real benefit if you all band together, as suggested earlier

Thanks, I'm a bit busy with month end work at the moment - but have bookmarked and will pop back either tonight or over the weekend.
