The CCBC will only issue a Default Judgment if asked to do so by the Claimant.
It was not possible for the Claimant to seek a Default Judgment until after 4pm today as that was the deadline for the filing of your Defence.
Even if the Claimant requested that Default Judgment after 4pm today, that request would not be actioned until after you Defence has been filed and of course once your Defence is filed, there is no possibility of that Default Judgment being awarded.

In that respect, you are safe.

    Hi all.

Thanks for your help on here previously. I have now received a letter from DCB Legal stating: "Having reviewed the content of your defence, we are writing to inform you that our client intends to proceed with the claim. The Court will direct both parties to file directions questionnaires in due course. In anticipation of that we are enclosing a copy. Without prejudice to the above, in order to assist the court in achieving its overriding objective, our Client may be prepared to settle the case. Therefore, in the event you wish to discuss settlement, please call us on 0203 838 7038 within 7 days"

Do I need to do anything at this stage? I couldn't see this in the pattern described here - https://forums.moneysavingexpert.com/discussion/6377263/dcb-legal-record-of-private-parking-court-claim-discontinuations/p1

    Thanks!

You may well have not seen it there, but did you see this in that checklist you were following when you filed a Defence?...
The rest of that checklist may well be worth another read.

    Thanks!

The discontinuations thread is only a tally; it isn't guidance on what to do when, so I'm not sure why you are looking back at that thread again.  It's inspiring but it's not a sticky advice thread.

The first 12 steps are in the Template Defence sticky thread.

Then later steps are in the NEWBIES sticky thread.

Hello everyone. I am returning to this thread as I've had a letter from the county court which I don't recognise from the steps outlined in the link above. It's titled "Notice of Proposed Allocation to the Small Claims Track." It's a form which contains an invitation to offer to settle and states on Page 1: "You must by ___ complete the Small Claims Questionnaire (Form N180) and file it with the court office. Could anyone very kindle give me or point me to the right advice which I should use to respond to this form? Thanks so much.

Perhaps you are not reading point 7 in the 12 point checklist. @KeithP has already pointed this out to you earlier.

You should go back to the defence template thread, make a copy of the 12 point checklist and keep it handy.

Thanks very much, that is noted. I'd also be grateful if anyone has any insight on how likely this means the claim will ultimately proceed to court? I'd be grateful to get a better understanding of probabilities. Appreciate all of your help.

Perhaps you need to look again at that thread you mentioned in your post on 15 May at 3:31PM.

Thanks, @KeithP — I did indeed review that, I was just wondering if anyone had insights on how common that pattern is as opposed to court cases proceeding.

I don't think the data you are asking for is available.

The data that you have seen is just the tip of the iceberg, but current thinking is that if you follow the same well trodden path then your resolution should be similar.

Suggest you need to concentrate on ensuring that your predicament is resolved in the same way as those other DCB Legal cases.

In other words... keep following the process until they discontinue.
