A default CCJ? I've followed the process and 12 points throughout and not deviated.
The latest 'notice of transfer of proceedings' just highlights that a details of the judges direction will be sent to me in a notice of allocation. By the sounds of point 5 on the below the notice of allocation which i'm yet to receive will then state the date of the hearing and the deadline for me to submit a witness statement.
5. The case file will then be transferred to your local County Court, and you will eventually receive a Notice of Allocation, giving you a date and time for the hearing. It will also specify a deadline for you to submit a Witness Statement, and any other documents you intend to rely on, usually 14 days before the hearing but sometimes earlier than that. Your Witness Statement can expand upon the points made in your original Defence, and must start with the following "I, Joe Bloggs, of 23 Acacia Avenue, Anytown, AN1 2BC, am the Defendant in this matter, and will say as follows". You should attach to your Witness Statement any evidence to support your assertions, eg photos of signage, etc. Optionally, you may also want to include a Skeleton Argument to flesh out the legal points, or you could include those as part of your Witness Statement.
You should now be following the guidance in the second post of the NEWBIES thread.
There is nothing you need to do now other than wait for a Notice of Allocation to drop through your letter-box which will give a date by which your Witness Statement and evidence must be filed.
You are of course right to be thinking about your Witness Statement now.

Over the past half a week I've been receiving both and email and a voicemail from the good people of DCBLegal offering me a counter-claim, a reduction in the charge... this is the second time they've been in touch - the first with a reduction of around 10%, now a reduction of around 20%...
Given that they are completely bogus 'fines' the plan is stay quiet and let the letter requesting my W/S commence...1 -

Uncle Thomas, appreciate your post, I haven't yet had the advised hearing date (which I wouldnt have done as DCBL are still ringing / sending me emails with counter-offers) but I do have my W/S 90% done...
I am ready to submit to to the email address I sent everything else to as and when I get the hearing date through by post @UncleThomasCobley

Hi all,
After 3 months of hearing nothing (though getting the odd missed call from DCB Legal) I have now received a letter 'Notice of Allocation to the Small Claims Track', dated last week and received today
What surprises me is the fact that the claim will be heard in February 2025 which seems quite far away.
The WS needs to be sent to all parties 14 days before the hearing which would be Mid Jan 2025... I will look to do this in the coming week.
I will turn to Jonny_86 WS again that he laid out in 2022/23 to use that as a template as well as create my own case / photos / proof of living at the address where the tickets were issued on the vehicle...
Lastly... by the time it goes to court the tickets would be over 6 years old, I guess as the claim has been put in and is with the court the 6 year rule goes out the window...?!

Very glad that your local court isn't prioritising parking claims. I suspect that allocating Judge has sussed that DCB Legal drop out.
Making them diarise this for a year's time will - I suspect - see this one discontinued early this year. They'll never keep in top of the deadline otherwise. Bad idea to do a half-baked WS saying vaguely that the DLUHC are reintroducing the statutory Code in 2024 and "it might say this/that", when you could wait till the Summer or Autumn and hopefully the Code has gone through by then (before the General Election).PRIVATE 'PCN'? In that case as I now have time on my side I'll look to revisit this in the build up to the G.E in hope that DLUHC have updated the code...
It mentions on the letter "as the order has been made without a hearing the parties have a right to apply to have the order set aside, varied or stayed",
Has it been known for a defending party to make a case to the court directly and successfully seen the order stayed / ended? I might be making things far more convoluted even considering this route or as above, do I sit back, wait and if the gods are smiling on me, see them discontinue in the coming months...1 -
Just sit back and see what DCB do.
