    Sorry, I could only find the walk through on NEWBIES from the old N180, without guidance to the the new question below: 

    Do you consider that this claim is suitable for determination without a hearing, i.e. by a judge reading and considering the case papers, witness statements and other documents filed by the parties, making a decision, and giving a note of reasons for that decision?

    So the answer is No.. which now makes complete sense... 

    I want the judge to take in to account the factual disputes and evidence that I, the defendant wish to present which puts these bogus claims from the claimant in to disrepute.

  • Apologies. I have now downloaded my completed N180 and will send it off to the CCBCAQ email address my defence was submitted to, cc'ing in the solicitor at DCBLegal that sent me their N180

  • Hi all, I received a letter from the court on Saturday

    "transfer of proceedings" sent to all parties that the claim has been transferred from the CNBC to my choice of county court and the judge will in due course give case management directions. 

    I guess nothing to do here, just file the bit letter and wait for more documents requesting my defence?

    Surely you have already sent your defence!  Maybe it will be the Witness Statement that will be required.

    It sounds I should wait a bit longer for the letter requesting the Witness Statement as I haven't yet received anything, although never does any harm me preparing some of it now so some of the work is done.

    You must go back to the Template defence thread and make a note of the 12-point checklist in the very first post of that thread. You follow the points.

    You will never receive a letter "requesting the Witness Statement" and if you did, you would most likely find yourself with a default CCJ. Go read the 12-point checklist now!
  • A default CCJ? I've followed the process and 12 points throughout and not deviated.

    The latest 'notice of transfer of proceedings' just highlights that a details of the judges direction will be sent to me in a notice of allocation. By the sounds of point 5 on the below the notice of allocation which i'm yet to receive will then state the date of the hearing and the deadline for me to submit a witness statement.

    5. The case file will then be transferred to your local County Court, and you will eventually receive a Notice of Allocation, giving you a date and time for the hearing. It will also specify a deadline for you to submit a Witness Statement, and any other documents you intend to rely on, usually 14 days before the hearing but sometimes earlier than that. Your Witness Statement can expand upon the points made in your original Defence, and must start with the following "I, Joe Bloggs, of 23 Acacia Avenue, Anytown, AN1 2BC, am the Defendant in this matter, and will say as follows". You should attach to your Witness Statement any evidence to support your assertions, eg photos of signage, etc. Optionally, you may also want to include a Skeleton Argument to flesh out the legal points, or you could include those as part of your Witness Statement.
