Right, well after worrying about this all day, I've bounced back 'the b&$ards will not get me down' and found some anger as a genuine user of the service being treated in this way - it's really boiling my blood now!
This is the draft of the Popla appeal letter I've drafted - it's taken me an absolutely inordinate amount of time to write and most of it is other people cut & pasted.
I'd really appreciate any comments. I'm also going to write a seriously strongly worded letter to the landowner and let them know exactly how I feel about their predatory practises. I initially spoke to the manager of the leisure centre and she claimed that they aren't the landowner and that I needed to follow CEL's appeal process, but they were 'sympathetic' to these issues. However, I've requested the details from the land registry and they are listed as the owner along with the dilapidated buildings to the side of the centre.
Sorry for the sheer size of this image - I managed to work out how to embed but not how to re-size.
And thank you again for any help - it's really helped to have somewhere to help me in dealing with this.

Good letter, although I think I'd leave out the paragraph about your intention to appeal to POPLA, as this gives the people to whom you are complaining the opportunity to agree that this is the next step for you, allowing them to easily swerve doing anything to help you. Not what you want. Seen it happen many times.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I did leave out the part relating to POPLA. I'm really not holding my breath as when I spoke to the centre initially, they claimed that they don't own the land, although the land registry says differently and they've been extremely unhelpful. I have signed my lad up for swimming lessons elsewhere though as I'm really through naffed off about this; so much time wasted. They're not particularly great at teaching swimming either although it seems to be a very oversubscribed area - once we get a place elsewhere he's not going to be bothered about not going to this particular centre.
